Well folks it's a new legislative year for every state except New Jersey and the bills are rolling in like wild fire, with a good chunk of them being anti-gun. Have a feeling it is going to be a rough year for gun rights advocates. Here what's already come in in the first 5 days of the year:

AB61 would add more people to the list of people that can file for a 'red flag' protection order

SB55 would make anyone convicted of two or more misdemeanors a prohibited person

A whole bunch of antigun bills have just been introduced in the Virginia legislature -- "Red Flag" seizures, one-handgun-a-month, bump stocks, civil liability for criminal misuse of stolen guns, UBC's, etc. But the one that worries me the most is an AWB that would supposedly outlaw any semiautomatic with a magazine capacity of more than 10 rounds (and presumably, the magazines themselves). Details are sparse. The actual legislative language of this particular bill hasn't been published yet.

The governor is pushing hard on all of these. The Republicans have a one-vote margin in each of the houses of the legislature, so they should theoretically be able to stop all of these bills. But there could be some defections in the name of "bipartisanship." But the worst part is coming with the legislative elections this fall, when the Democrats are expected to gain control of both houses. After that it will be open season on guns.

For the purposes of VA law, if I remember correctly, "designed by the manufacturer to accommodate a silencer" means anything with a threaded barrel.

That Remington 700 with a threaded barrel? Assault weapon.

I just read the bill. What a mess. It's based on existing law, which was enacted after the Kansi incident and is poorly drafted to begin with. Magazine capacity of over ten rounds is important if the gun is equipped with such a magazine "at the time of the offense." That means you should be OK as long as the magazine is out of the gun. (Buy 10-rounders for all your pistols just to be safe.) More worrisome is the language "designed to accommodate a silencer" (threaded barrel) and the mention of a folding stock. Would pinning a flash hider permanently in place, and pinning a folding stock permanently in the open position be enough to get around this? That would remain to be seen. I'm at least glad they didn't mention bayonet lugs.

The magazine ban provision applies to "importation, sale, barter, or transfer" of over-10-round magazines. Mere possession is not affected. That means that (unlike what was done in New Jersey) the magazine provision has a form of grandfathering. They avoid the compensation issue and also potential conflict with the Virginia Uniform Machine Gun Act.

For you Virginia people ... sub-committee did the right thing and voted down over a dozen anti-gun bills:
This outcome was expected -- by both sides. I could tell that the antigunners weren't serious by how sloppily drafted the AWB bill was. But watch out -- these bills are placeholders for what is to come after the November elections.
