I believe GCA of 1968 & NFA of 1934 should be repealed. If someone can not be trusted to be loose in society then execute them or keep them locked up. If they can be trusted to be loose on the street they should have their rights.

I agree that the scope of what constitutes a felony has become waaay too broad.
Im not sure if the trend has come about because of malice? Or just laziness, and the creation of a leverage against the accused, to bring more to bear on them, in the hopes that they will accept a "reduced" sentence. I do not know. Could be both or neither

I also agree that once a person has done their time, paid their restitution, etc...their rights to vote and to an armed defense should be restored.

If they are still a menace to society, than what are they doing out and about?

I wont get into how I feel we should punish the cold blooded violent offenders.
(It may have to do with a certain slip knot, short drops, and sudden stops)
 
Remember too, you can lose your 2nd amendment Rights if someone perceives a threat, of ANY kind any threat, be it verbal or physical or just precived and a "Domestic Violence" or assault, 4th degree charge, a misdemeanor , that will bar you from owning any firearms for LIFE.

Happened to a friend of mine. GF was a coke head he didn't know about; found her stash, was throwing it down the toilet - she was punching and fighting him and he shoved her into a wall as he flushed, and she filed DV charges. He relied on the "honesty" of the system, and lost his guns and his rights forever due to a DV charge - even though SHE was the coke head and should have been doing hard time.............................

IMHO if someone is so bad you cannot trust them with guns, then WHY are they still loose in society?
Because we don't have enough storage space to house the great number of dangerous criminals who live in this country for the rest of their natural lives.

Or just save felony charges for the most extreme (aka violent) offenders while 'nonperson' felonies are reduces to misdemeanors with no loss of rights.

We have far too many laws that are felonies instead of misdemeanors.

It is mine. If you didn't rob,steal,rape,murder,assault, molest....you get the idea. If you DID? You Don't Belong Among Us. Everyone else? Time done?/Probation/Parole done? No further obligations? All rights should resume. Either you have them all,or you have none. Anything else is makework for the system, a sop to the badge-polishers; and dishonest to the extreme. If " rehabilitation " is not the point? Admit it at least.
 
To some extent, this is all folly. Prohibition of felons from possessing firearms will never stop felons from obtaining and possessing firearms. Since we do have these laws prohibiting this, there could be more prosecutions.

I say that since we do have these prohibition laws, they should be limited to violent felons only.

I'm just not concerned Martha Stewart is gonna come gunning for me.
 
Curious if anyone else posting in this thread so far has actually spent any time inside a prison, on either side of the fence. I have, and based on what I saw and learned during that time, I can tell you it's exceptionally difficult to leave prison a better person than you were when you got there, and that's supported by statistics and recidivism rates.

yes, this "thinking individual" believes all felons should lose the limited right that the general public has to carry a firearm.
You know you commit felonies every day right? This is proven. You're just a sorry felon that hasn't been caught.
 
Drag racing is a felony in some places. Change that back DOWN to a minor misdemeanor for starters.

Pot possession is a felony in some places. Change that DOWN to a misdemeanor.

Assaulting a cop - felony. Assault your neighbor - misdemeanor. The cop is no more important than your neighbor and the same crime should never be given different punishments. Either both should be misdemeanor or both felony. Neither is better than the other.

This is why we have so many screwy gun control laws. Too many places passing laws that do their own thing.

See where this is going?

Most of our laws are unconstitutional anyway. They are just there to empower the government and take away gun rights.

Why does everyone ignore that pesky 9th amendment?

What the 2nd amendment doesn't cover the 9th kicks in to make SURE we still have individual gun rights unless incarcerated of course.

What defines a particular punishment is how laws are passed.

Certain criminals should never be let out to prevent them from getting guns and screwing it up for us law abiding people.

Certain meaning kiddie rapists (raping under 12), violent rapists, severely harming/maiming another, killing someone, similar extreme crimes.

If we never had bad criminals we might not have gun control laws at all.


But that is another issue.


Until society is free from violence and bad people, we need to stand firm and work to expand gun rights everywhere.


And get rid of cop mentality to arrest first and let judges decide later. This ruins people's lives forever.

A clear self defense use of a gun should NEVER facilitate your arrest or even be handcuffed.

Once a person serves their time and completes parole they should get back all the rights enjoyed by the rest of us.

BTW: I don't believe for a moment that this guy got busted for child pornagraphy for a selfie on his daughter's computer. Doesn't pass the sniff test.
 
I do not know anything other than what he claimed.

And yes, it is very plausible that his daughter or someone else put that on the computer.

What I did not figure out is how the police found out about it and arrested him.

I tend to take people at their word unless I see evidence to the contrary.

And Mike J, you forgot we need to abolish Brady Bills I & II as well.

What are these felonies that people commit everyday without knowing it?

I'm pretty sure if you asked most people in prison they would tell you it's all a mistake and that they actually didn't commit the crime...

However, I think it would make sense for there to be a process to have an individual's rights restored. If you've been out for 5 or 10 years and have you life together it seems like it would make sense to restore the right to vote, own a gun, etc.

It's a pesky thing called the IP Address. That is how the majority of Internet child porn downloaders are caught.

I also have to beg to differ on some points...
Jobs are available to felons, in fact, you would be surprised at how many companies hire felons and make use of Federal and State bonding programs to help eliminate the liability when hiring at risk people. In addition, many felons resort to additional crimes not because they can't find a job, they just can't keep a job due to untreated or unaddressed problems, whether they be emotional, physical or psychological.

I'm not even going to start talking about the degredation of the morals and values of our society, how going to prison is not considered negative by some and how the Government and schools are raising our kids due to the lack of parental role models and the need to have double incomes.

I work in the prison system and have been involved with many programs to include Veterans initiatives and Vet Dorm programs to help reduce recidivism rates among vets. I teach the Vets that you are in charge of your destiny and that you cannot blame society for what has happened and what is to come. Take charge of your life. If you want to petition for a restoration your rights or even a full pardon, then become a leader in your church or community and make a difference.

As for felons with weapons, I believe that your first arrest, provided that it is not murder or major crime should be sealed and your should get a second chance. Get arrested again, it is all about yourself.
 
This, of course, is my thoughts on the matter. I DO NOT want child molesters, arsines, burglars, etc allowed to carry a gun.
If you screwed up and are a felon. . . . . tough <removed>, live with it (without a weapon).

DeepSouth/hatt: simple curiosity, as for the average American committing felonies every day...

If somebody only hangs around the house all day (no car drive), might eventually find a bag of Tostitos chips that a wife has skillfully hidden (she is diabolically clever), how do they figure that even One felony was committed? Only Surfing Internet for gun websites/ammo prices, news and Youtube for "relaxing sounds" to help a nap.

This was done in the days even Before a jog around the neighborhood with a concealed Makarov or P-83 Wanad, in a Remora holster (with the TN CCW permit).
And my last gun purchase was in mid-Dec. in a nice Cordova TN gun shop. They did the background check, according to procedures. Those stats on felonies--with no common examples provided by them--appear too bizarre.

I have mixed feelings about the subject. There are a lot of good folks with bad history. I have always felt that if a person was square with the govt then he should be able to regain his rights. I think it's silly that people get felony charges and are suddenly marked for life. Hard to find work, loss of rights, punishment for life for a drug charge, for a simple fight, etc. Now I believe our jail sentences need reviewed as well.

Until May 2013 it was a felony to homebrew beer for personal consumption in Alabama. When I started in the hobby I was not aware of that fact.
 
My 2 cents. If they serve their sentence their gun rights should be restored. There can be special circumstances in which a Judge could take the right to bear arms from someone after serving the time. But as a requirement I think it is way too harsh.
