Can I ship ammo to Buffalo NY to resident directly or it has to be FFL?

The buyer
sent me an address in PA but it is different person name, would it be legal for me to send to that address? I'm trying to get rid of unused calibers, but not want to break any laws.
 
Question, if the OP does send the ammo to a private individual in NY, who is legally at risk, the shipper or the receiver? Seems like it would be tough for NY to prosecute someone in Illinois.

Just mere days after celebrating our great nation’s independence, Republicans have taken a huge step forward for Second Amendment supports and making substantial changes to New York’s SAFE Act by fortifying an obligatory “memorandum of understanding”(M.O.U). State Senator James L. Seward has pushed for change since the 2013 when the SAFE act was originally sanctioned.

Gov. Andrew Cuomo has agreed to suspend plans for background checks for ammunition sales in New York and allow internet sales of ammunition, changing part of the NY Safe Act, according to state Sen. James Seward.

“While I will continue to work for full repeal of the poorly crafted, over-reaching NY-SAFE Act, this is a significant accomplishment—and constitutes the only modifications that have been made to this law since it was enacted two years ago over my objection”. Seward has continually stated that the database for ammunition was faulty and "fraught with problems since it was first conceived," and be removing this aspect, it will prevent any future money from being squandered. With the backing and support of Senate Majority Leader John Flanagan and Jim Malatras, director of state operations, this can only be considered a big win for both the State of New York and for its private citizens. The focus of these changed laid in two parts “The two provisions that will be changed are both related to ammunition. The MOU, which was signed by New York State Director of Operations James Malatras and Senate Majority Leader John Flanagan, puts an end to the portion of the act that would establish a database and require those who purchase ammunition to undergo a background check. It also ends the moratorium on on-line purchases of ammunition”.

07-14-2015 This is what is on the web site of TARGET SPORTS USA ..... targetsportsusa.com in the "news and press releases" section which explains why they will ship ammunition to NY state outside of NYC anyway. I have purchased ammunition from them when no body else would ship to NY state and I'm as confused as the OP. I have also recently sold some collectible ammunition and shipped it out of NY state to another state via UPS with no problems. This seems to be a complex topic and it would be great to get some clarification on it and THR is always a good source for getting information from folks in the know. All I know for sure is that the state still hasn't got a database and the original safe act has proven to be vague in a number of things. The way it appears to me would be that ammo could indeed be shipped to a resident of Buffalo NY; but on the other hand I'm confused as to why so many other businesses refuse to do so. The OP has raised a very good question to which there seems to be no clear definitive answer. Could anyone shed some light on this?

And what makes you think Cuomo's agreement is actually worth anything? He's governor and can't change the law. He could, as governor, direct state law enforcement not to enforce the law for now. But that's not binding on the courts or local law enforcement. And he could change his mind at any time.

One relies on this sort of executive discretion at his peril.
 
I agree and that's not what I was saying; that's off the targetsports usa web site and it has me and many others confused about why they will ship ammo to me in western NY state while everyone else I've seen won't. I'm under the impression that the M.O.U. (memorandum of understanding) isn't set in stone but should, at least for now, allow out of state businesses to ship ammo to residents of NY state. Now I'm thinking the deservedly bad reputation that the safe act has is causing many out of state businesses to be afraid to have any dealings involving ammo sales that go to NY state. Please note that I refer to NY STATE and not NY CITY as NY city is a whole different ballgame concerning this sort of thing and has their own regulations about it. So now I'm still wondering about the OP's question.

And what makes you think your impression is correct or is sufficient reason for someone to rely on it and ship ammunition directly to an individual in New York? Are you a member of the New York Bar? Have you read the MOU? Have you done any research into the status and legal effect of the MOU under New York law?

Or, perhaps, they're wiser than Targetsports and have concluded that relying on the MOU is a bad idea.

As you should. And more to the point, so should the OP. He certainly shouldn't rely on your impressions.
 
Look like this discussion missing the point. Buyer provided a second shipping address not in Buffalo NY but in PA, new address not in his name tho.
My question now - can I ship to that address, if that a different person?
