an 03FFL records question on which license to record.

If you buy an 03 eligible handgun but the dealer will not ship directly to the 03FFL holder and requires a transfer, is the seller license or transfer license the one to record in acquisitions? The gun in question is a Chief's Special, pre-model number and so certainly eligible by any standards.

It is certainly something I should know but even though I first got my 03FFL back in 2001 this is the first time I've dealt with a seller refusing to ship straight to me.
 
Actually, I'm not sure why you would enter anything in your book. When you get it from your transfer dealer he will, in all likelihood, treat it as any other firearm and not as a C&R. If that's the case, you treat it as a non C&R. If he transfers it to your C&R, you treat it as you would any other C&R.

It can't hurt to log it and I tend to err on the side of caution.

If you are an 03, you must log-in any and all C&R guns you acquire, no matter what the source or how you acquire them. You can't make the determination on what guns you possess as C&R or non-C&R.....they am oh they ain't.

My question would be whether you need to log in a C&R eligible firearm even though it was not transferred to you on your C&R license? I can understand that any gun you buy using your C&R license would be logged in as a C&R, but if you don't use your license, I can't see why it would.
 
The transfer agent logs the sellers info. You log the transfer agents info (the person you received the firearm from).

To comply with ATF regulations, the 03 licensee records the acquisition and disposition of ALL curio & relic firearms while he is licensed. Where/Who/How he received the firearm is immaterial.


I can understand that any gun you buy using your C&R license would be logged in as a C&R, but if you don't use your license, I can't see why it would.
Then you need to read ATF regulations.;)

Look at it this way.... You don't get to pick and choose when to use your C&R License, it uses you each and every time you acquire or dispose of a C&R qualified firearm.;)

I let mine lapse earlier this year, and once I quit being a C&R I destroyed my bound book. Since I am no longer a C&R I am no longer subject to those documentation requirements. Should I renew my C&R in the future I could choose to record all of the C&R firearms in my possession, OR I could choose to only record those that I acquire/dispose of from that point forward.

I asked that question and the answer I got is that after re-establishing C&R you post any you dispose of that were acquired under the earlier license as from Personal Collection.

Aside from the point that has already been clarified, I've had no problem with any transfer dealers logging C&R firearms out to me. They all realize it is an easier transaction and less paperwork to store. .
