Durability of Trust in Different States

I have a trust for my NFA items. The trust was drafted by a lawyer in PA and includes myself, parents, and siblings on it as trustees. We all lived in PA at the time the trust was drafted so our addresses are PA addresses on the trust. I am in the military and am now stationed in NC. Am I able to use the trust, without amending it, to purchase NFA items in NC? If so, what is the process and things I need to be aware of? My concern is that if I buy from an NC dealer that either the dealer or ATF will become confused or return the tax stamp application because they’ll see PA addresses in the trust, but I am buying from an NC dealer. I want to remain legal, but I prefer not having to pay for a new trust or to have the current trust revised.

Please don’t guess or provide assumptions or provide cop out answers like “just get another trust.” Please address the question of whether the existing trust can be used to legally purchase items in NC.

1. The use of a Trust isn't any advantage now. You'll still need to have fingerprints and pictures for ALL persons on the trust. Personally I'd just buy it and not put it in the trust.

That is not true as there are advantages to using trusts in having shared ownership, the ability for other trustees to retrieve NFA items from the dealer if I am out of town, the ability of trustees to use NFA items belonging to the trust, etc. While you may not find a need or want for a trust in light of 41F, these are major advantages for me.

2. While convenience of not needing fingerprints and photos was one reason why I initially set up the trust, it was mainly for the reasons stated above.

3. The fingerprints and photos requirement for all trustees as a result of 41F is a nuisance. However, my trustees and I have our fingerprints and photos in Silencer Shop’s system which is my primary source for suppressors which are the majority of my NFA purchases. Silencer Shop will also process Form 1s using the existing fingerprints and photos for $35 or I can roll fingerprints and take photos for my trustees.
 
You really need to talk with an attorney familiar with your trust document. The language of the trust and state law will control how it operates. There are plenty of generalizations about trusts which can be thrown about, but without understanding how your specific entity was structured any answers are more educated guesses than anything else. So how/if to amend is totally unknown.

Not legal advise:

Can an out-of-state trust purchase an NFA item and take delivery? Pretty sure the answer is no. The trust is a separate legal person from you. If your trust is a PA entity and has not changed its domicile, the item would have to be shipped to a dealer back in PA and have the trust complete the transaction there.

Per atf.gov/firearms/docs/atf-national-firearms-act-handbook-chapter-9

Section 9.3 Interstate transfers of NFA firearms. ATF will not approve the transfer of an NFA firearm to a non-FFL/SOT residing in a State other than the State in which the transferor’s licensed business is located or the transferor resides. Such interstate transfers would violate the GCA.
 
I'm going to call this one. This isn't the sort of question one can really expect a decent answer to on-line. Among other things, the first thing a lawyer will want to do if asked whether someone can do something under a trust is read the trust. There is no way to properly answer such a question without doing so. And then comes the research.

The OP would be well advised to hire a lawyer and get this taken care of properly. The possible consequences of getting sideways with ATF on an NFA issue are highly undesirable.
