The case involved a pair of men who were convicted on several felony robbery charges, but were also convicted under another federal statute that required significant mandatory minimum sentences for a "crime of violence."

Both men were convicted by juries of brandishing short-barreled shotguns, triggering a 35 year-long mandatory minimum sentences. Davis received more than 50 years, while Glover was sentenced to 41 years.

When you get right down to it, laws need to comprehensible and clear. If they aren't, they may as well be arbitrary.

. . . and this from someone who'd cheerfully support making the use of deadly threat in the commission of a crime a capital offense. I see no reason an armed robber needs to survive past a jury conviction, but he absolutely does have a right to be judged by clear and comprehensible law.

So I’m glad to see this, even though I’m for being tough on criminals. He’s right. Laws need to be specific. Too broad and we’re all criminals.

So imho it’s a good decision and his opinion and justification on this case is excellent.

Agree. And this will be a continuing problem in this country. The Politicians have more or less abrogated their responsibilities and are letting judges decide how to manage society. We have all lived, and will continue to live, through the Judicial creation of "rights", that were never there in the Constitution, and were never voted on. But once a Judge decides, it is forever.

I had a discussion about school busing with a bud. Some Liberal Judge decided to mix and match children of ethnic and economic levels, to achieve some Liberal utopia. Bud lived within walking range of a good school, but the one the Liberal Judge had decided he had to go was over a half hour driving time away. His parents had no vote or voice in the matter, because Politicians had decided to let the courts implement "judgements" to manage society. And you continue to see this in vague laws where Politicians just pass "something" and let the courts figure out what it means.

Which sort of begs the question, who needs a legislature if they are going to act like that?

Maybe we ought to get rid of the buggers and figure out a way for the people to run a Government through the internet.
