Red Flag Law

Would you favor a Red Flag Law as described if it helped to prevent further measures ?

Even if their is due process, my issue is I can either go up against who? A DA, a prosecutor, a lawyer of some sort I’m sure... I can either go about itself or hire a lawyer?

Just what someone wants to be doing in middle of paying for a divorce, all because someone, said ex-wife maybe, made a phone call and told told some lies.

This. I’ve seen folks file for a PFA (protection from abuse) and part of the order is the surrender of your firearms and pistol permit. The threshold to get an ex parte order is so low it’s laughable. We sometimes refer to them as the trailer-park or white trash divorce.
 
Can someone red flag Johnny 20 something because he lives in his parents basement looking at porn and making weird posts on social media all day? Also he is socially awkward and was bullied during school and is pretty quiet.

Look for the gubment to pour money into domestic spying initiatives and more FISA-type warrants. At the local levels these “red flag” laws will gain some traction. That’s the death of your 4th and 14th Amendment liberties and protections. (I wouldn’t worry so much about the 2nd because the way to eliminate that is by eliminating your 4th and 14th first.)
 
Basically, I'm for the idea in principle. However, Red Flag laws appear to be headed toward committees in Congress. With this lack of information it hard to make a reasoned decision. As it stands now locally there have been examples of confiscation without due process. This business of having family members given the power to remove firearms sounds fishy. Locally, people can be held for evaluation with sufficient documented evidence. How do I know? Been involved in upteen cases where people have been given a CON, certificate of need. These people were transported by the sheriff'sdepartment to a mental health facility for an evaluation. Where I'm going is wait and see what is proposed in a Red Flag law. As usual the **** house lawyers are agitating. How about stopping the speculation and find out what's going on.

If they do have due process for you to get your knife back than I am wrong. However if it was already a 'legal knife' it would not have been seized so due process would assumedly be that you bring an accurate ruler ?

Some people will not mind living in a country like Ole' DDR under watchful eyes of Stasi and informers. The Liberals are ready to jump into the pool trusting that government officials will fill it full of water before they hit.

My concern is false allegations. If the charges are proven to be false, the person , or persons, should be liable for all of the defense expenses (attorney fees) and fines for each day the defendants constitutional rights were suspended or curtailed.
 
Your premise is based on one is guilty until proven innocent. At least this is what I understood.
 
Still do not have any solid information on what exactly these Red Flag laws will be like. From my experience it's not an issue of guilt but of mental competence and the treat of harm to self and/or others. How did these individuals come to the attention in the community as a threat? We need some solid information. I don't appreciate those running around like a goose with a bell clapper up it's rear.
