Possible Walmart OC trespasser banned

Just a heads up. I got an unconfirmed report in an email from the VCDL. While unconfirmed, it is entirely possible, and AFAIK (IANAL) within Wal-Mart's rights, that they have permanently banned a customer for OC'ing in a Kentucky store. From the email:

VCDL has been made aware of an incident at a Walmart in Kentucky where someone open carrying a handgun was approached by police and asked to sign a trespass document saying he acknowledges being banned for Walmart property anywhere in the U.S., indefinitely.

That contradicts the official policy as laid out by Walmart's CEO.

I have also heard from a third party that Walmart is going to post their stores "no open carry." However, I'm not taking that as Gospel until someone actually sees such a sign.

In the mean time, I recommend that you do not open carry in Walmart for at least a week until we see if such a sign materializes or we get more definitive information from Walmart.

Concealed carry remains a safe option, as Walmart's policy specifically allows for such.

From KY here. The guy was at first sitting in a lawn chair by the gun counter doing a Facebook live of himself showing off his gun which was dumb. In KY "no gun" signs do NOT have force of law, and Walmart didn't even have a sign posted anyways. Police arrive and a manager demands he sign an agreement to never enter a Walmart again, which he should have NEVER done without legal council! They had absolutely NO grounds for arrest.
 
Many casinos use facial recognition. They spot whales (desirable high-rollers) and cheats the instant they step through an entrance. It's critical to their business to respond appropriately to these people.

Walmart, Whole Foods (Amazon stores), Krogers, and Costco will expand the use of facial recognition and weapons detection technologies as soon as the need is pressured on them enough.
 
As an avid gun owner, I ask myself why would I want to “OC”; I cannot think of one good reason other than “it is legal”. I do not want anyone to know that I am armed and I do not want to intentionally cause people to be uncomfortable. OC is reserved for a certain kind of personality (especially in a present day Walmart). Being armed and common sense are not mutually exclusive.

I saw nothing in the OP to indicate an arrest was made. Was there one?

Since Wal-Mart is a private entity, maintaining private property, they can indeed bar anyone from entry onto it (assuming Federal anti-discrimination laws are adhered to; firearms-carrying is not yet a "protected class.") Whether the individual signs the document or not, he's still banned. All it takes is a representative of the proprietor to issue the warning in the presence of law enforcement. Now, I do have doubts about whether or not a store manager has the authority to ban an individual from the grounds of any WM property nationwide.

Let's not be try to turn this into yet another "OC vs CC" thread. Those don't tend to remain open very long.
 
I suppose it would have been better form on Walmart’s part to ask the guy to leave first before going straight to a lifetime ban.

You could suppose maybe they did and that was not part of the story but if they did and the guy refused then they would have grounds to arrest.

If they told him to leave and he refused they did.

When I took the CCW class the instructor specifically told us if we got caught defying a "no guns" sign then the store could tell us to leave. We were guilty of trespass if we didn't.
 
Showing off his gun on facebook while in a Wal-Mart at the gun counter. Considering the number of recent shootings in and around Wal-Mart's and across the USA as well, I imagine that would make most customers uneasy to say the least. I'm glad they got him out of there and I don't know the ban policy of Wal-Mart but I don't feel sorry or sympathize for this guy at all. IMHO he should be banned for being dumber than a box of rocks.

For crying out loud - this guy was a complete knob. Throwing gas on an already ugly fire for - what - 5 minutes of fame? Just look at him mugging the camera and making a stupid hand gesture at the end of the video , a selfish video fame grabber who does not give a whit about the well being of society as a whole.
The possible good that could come from his actions? Zero.
The overall public perception harm? Plenty.

Lets put this in a slightly different context : If you ran a bar and this guy flashed his weapon and bragged about it , would you
a) Buy him a drink?
b) Throw him out?

For me it's B without hesitation.
 
If this was the guy in Lexington Kentucky my understanding is it this actually happened before Walmart announced that they were banning open carry.

Again this isn't firsthand but I also understood that nobody Walmart made any attempt to contact him and that the first that he knew that anything was going on was when the police showed up.

Having said that he signed a document not to ever go to any Walmart or Sam's Club location anywhere in the nation ever again. Do you really think the people at the Walmart in Paducah or going to recognize him when he walks in the door?
 
All this based on what factual report evidence??. Sounds like hearsay to me without any supporting facts
If it did happen the guy was an idiot.
