Midway USA has goofy rule for dealer's account

So tell me what you think...

I currently own a gun accessory business. This is a bona-fide business with a Tax Permit and Business License, etc. I used to have an FFL for 6 years, but living in California, finally gave up on it as being too much of a hassle.

I just recently tried to re-establish my dealer's account with Midway USA, which I had for 6 years while I had my FFL, but they denied me stating that I did not have the word "Gun" in my business name.
They did not seem to care that I have accounts with all the major wholesalers in the gun business, such as Davidson's, RSR, Jerry's Sports Center, Brownell's, etc.
Thier rules state that they will only do business with companies that are clearly related to the firearms industry by having the word "gun", or similar, in thier business name (there are other rules too, but this is the one that affects me).

I find it odd that a company would have as its business model a rule that would turn away a bona-fide business customer.
Does this mean that they make so much money that they don't need mine?
I really don't what the intent of this rule is... every single other company that I do business with only requires that I have a business license or tax permit; some require that you have an actual storefront, but that's a different story. Maybe Midway somehow thinks that they are protecting someone?

Also, it's not like I can't get everything they sell from somewhere else anyways - they would just be another source.
But still... a company whose business model is to turn away people who want to spend thier money with them is certainly something that I have not ran across before.

One last thing to say... I wish my business was so successful that I could tell people that I didn't want or need thier money.
 
My guess is that they don't want everyone who owns any kind of business to try to get their personal orders discounted by claiming to be a dealer.

I know that I'd be tempted to open an account in the name of the company (electronics manufacturing) I work for, just so I could order my goodies at a discount.:evil:

I say you should get a C&R FFL and send them a copy if you want the dealer rates.

I thought that too, but every Tom, Dick, & Harry DOESN"T have a business license - and anyways, I offered to show them invoices from my accounts with the other "gun" businesses I deal with and they said "it don't matter".

Brownell's, a similar business to Midway, doesn't have that rule, and they are still successful.
 
Just for fun, what is the business name? Its not like Toms Laundry, QuickyMart, or Bobs Online eBay Shop is it?

What percent of your business is "gun accessories"?
 
I can go downtown and get a business license for $20 in about as many minutes. Doesn't mean I have a business, or anything related to the shooting industry.

You have to send a hard copy of your C&R.
 
I once had an issue with Midway, and wrote directly to the owner. He wrote back, was congenial, and I was satisfied.
If you are talking to the guys who answer the phone, they are NOT the owner.
I suggest a short letter, with copies of your invoices, and other pertinant info, address directly to the owner. I am sure there are guys who only sell guns and gun parts, and they don't have the word "Gun" in their business name.
This sounds like a clerk interpreting the policy.

My business name on the license is my name with "Co." put on the end. If you have your name as the business name then you do not have to file a "Fictitious Business Name" application, along with the fees associated with it - and I'm not about to change it just to make Midway happy. I have had this Business Name for nearly 10 years now with no problem, other than this.

My business is nearly 100% gun related, but I also sell an occasional fishing reel every now and then (and knives too).

- Signed copy of your Federal Firearms License (FFL): The FFL must be signed in ink and the FFL number and expiration date must be legible. This information may also be faxed to us at 1-800-992-8312.
- Business or Merchants License: License must be issued by a State, County, or Local Government office for a business whose name and nature relates to Shooting, Reloading, Gunsmithing, Hunting, or Outdoor Trades.

MidwayUSA supports students enrolled in a gunsmithing program by offering Dealer pricing. We require a letter from your Registrar verifying enrollment, or a copy of your current schedule of courses that shows you are enrolled in a gunsmithing program.

Dealer pricing is also extended to customers in Government, Military, Police and Institutional Departments with GMPI status. Documentation on official letterhead, purchase order or requisition form, and a list of personnel authorized to use the account must be supplied.

I thought 01 FFLs could be faxed, but C&Rs had to be snail mailed, because a C&R can't be verified online...

I faxed mine and they took it.....

I buy C&R guns from all over with faxed copies of my 03, no issues at all.
 
While not a dealer I had one problem with a shipment from Midway.
Any way you look at it the shipper was to blame. The folks at Midway stepped up and corrected any/all problems.
I highly recommend them.
 
Seems to me that they had to make a decision on the policy so that an unskilled hired hand could easily make a decision and don't allow any deviation from the policy. Contacting the owners directly might result in a variation.

In our business, art, we wholesale to anyone with a tax number. You could be selling cars or appliances for all we care. However, we don't bend on getting paid!
 
+1 to contacting the owners, or at the very least a manager. Midway has been nothing but good to me and the last thing the industry needs is one of their top retailers being dragged through the mud because of a silly rule misinterpreted by a minimum wage call center dork.
 
FWIW, I've had to provide my FFL to a number of companies that don't even manufacture firearms. They just wanted to be sure I'm in the gun business, which I can respect.

Would filing a DBA work for you? or does that basically make it the same as starting from scratch??
 
I would definitely get clarification because the C&R folks don't even have to have a business name to get the dealer discount (I know 'cause I are one).

Seems to me that their dealer discount often doesn't amount to much.
It depends on the item. Most of the stuff I buy isn't discounted much, but I've seen some hefty discounts on their site. Even still, the discount has paid for my C&R, so I can't complain.

If I was you, I'd mention that I left the word "gun" out of my business name so as to avoid being harassed by the administrative types in that anti-gun state. Ask the owner for an exemption from that rule. Maybe take pictures of your gun-accessory shop, customers buying accessories, etc.

And be nice.
 
I've had excelent service from Midway over the years and now I onlt have a C&R....It works well for Me.........Essex

I looks like you just need to send proof that your business is firearms related.
 
Just get a C&R FFL..30 bux and youre done, I dont see what the big deal is. Or just use another company.

Af per January 2007, ATF has made it clear that Emailing FFL's is good too...fo if you dont have a fax, e mail it to them
