Gun accidentally discharged at Provo restaurant

PROVO -- The sound of gunfire disrupted a quiet lunch at a popular restaurant in Provo. No one was hurt Wednesday afternoon when the gun fired at the Olive Garden restaurant on 504 W. 2230 North, but it rattled several customers who were shocked to hear a gunshot while eating lunch.

It's another case of a gun that belonged to a concealed-carry permit holder going off in public. No one missed out on their lunch except the man with the gun. He was taken into custody by police until they determined what happened was an accident.

It's the second time in just a couple of months that a concealed weapon permit holder's gun has misfired in a public restaurant.

Talia Hudson and her mother had looked forward to meeting for lunch at the Olive Garden for a month. While they were enjoying their meals, they heard the loud bang. Hudson said, "We were just sitting there and we heard this bang, and my mom said, ‘Is that a gunshot?' And I said, ‘That's a gunshot.' And she said, ‘No way.' And I said, ‘I think that was a gunshot,'"

Other customers heard the shot and also believed it was a gun.

Customer Barbara Kunzler said, "Our server to our table said it must have been something that just dropped, and we said, ‘No, it was a gun.' And she went and investigated and said, ‘Yes, it was a gun.'"

The gun is a 9 mm handgun.

Lt. John Geyerman, with the Provo Police Department, said, "An individual had a concealed weapons permit. The gun was in its holster on its side. He was sitting down in a chair and reached down to do something to the gun, and it went off and discharged one round into the chair."

Police took the gun's owner into custody, and he was questioned at the police station until officers decided the gun was accidentally discharged.

Less than two months ago, on Jan. 13 at a Carl's Jr. in Centerville, a 26-year-old man's gun fell out of the holster and fired while he was in the bathroom. The bullet blew the toilet apart, but no one was seriously hurt.

The state agency that issues concealed-carry permits calls cases like these unacceptable.

Jeff Dunn, an investigator with the Utah Department of Public Safety, said, "You do have negligent discharge. I wish I could say there wasn't. Some people do make mistakes, but I wish I could say there wasn't because firearm safety should be No. 1."

Provo police released the man Wednesday afternoon and cited him for discharging a weapon within city limits, a misdemeanor. They kept his gun, however. The state will investigate and decide if the man will get to keep his permit or if it will be suspended or revoked.

This is the 2nd one in the past couple of months... I don't think it ever happened before with a UT CCW holder. I wonder if they just hired these people to make us look bad.:scrutiny:
 
Hopefully, this kind of thing is going to stop happing so much. If someone ends up getting killed or hurt from a CCW accident thats gonna hurt our cause bigtime.
 
I was just thinking the same thing about them being hired by the gun control advocates. The toilet destroying one was pretty funny though.

I hope I don't react that way if I hear gunfire while I'm eating at Olive Garden. Seems like a good way to sit there and get shot.
 
Police took the gun's owner into custody

Very smooth way to make the gun itself sound culpable. By referring to the man as "the gun's owner", they make the gun out to be anyththing other than an inanimate object. You often see this type of statement when a dog bites someone and other similar situations where the source of the damage/disturbance is caused by something living.
 
Barring some sort of incredible detail or pertinent fact in this event, the guy has no business with CCW permit. He's lucky nobody was injured.

Also as one who regularly battles the anti's on this subject, a heartfelt thanks goes out to him for his responsible behavoir. Not!

Accidents will happen, but when you carry a gun, usually you can't afford to have an accident.

I have had 2 accidental discharges in my lifetime, one with my .22 rifle years and years ago, another with a shotgun last year (stuck trigger), and both times THANKFULLY, the gun was pointing exactly where it should be pointing, in the air away from myself and shooting party.

When you have a handgun in a public area, usually you don't get a second chance, let's hope we see no more stories like this.

he either had a Holster that did not cover the trigger or actualy manipulated the trigger.

either way, stupid guy.
 
It was a no-brainer prediction that the Obama panic would result in more neophytes carrying, and therefore more Plaxico accidents.
 
excuses hurt us all

I suspect this guy made up the story about the gun firing after falling to get out of trouble. more likely he was playing with it and inadvertently pulled the trigger. but of course, he blames the gun- thus providing fuel for the antis...
 
Modern pistols and revolvers are drop safe. Period. He activated the trigger.

With the record number of CHL's being applied for and issued, I am afraid we will see more of these incidents, if for no other reason than pure probablilty and statistics. There is so much material to be covered in a relatively short period of time. Almost all of it bookwork. Minimal trigger time, and certainly not enough time to drill safety until it becomes habit. For those who need a CHL but have little training or mentoring before beginning to carry, special attention to safety is required.

If any of you know someone who wants a CHL, help them get training or at least some range time with you before taking their act on the road. Impress on them the NEED for safe habits. Probably the safest among us are those stuck somewhere between ignorance and complacency. These incidents do not help the cause of RKBA, and we all need to get involved in keeping new owners/CC'ers safe.

Too bad the ND at the MN gun show last month wasn't dealt with in the same manner! Can you say "special treatment and cover up for LEO in MN"?

First of all it is the laws of averages. The more people you have carrying the more likely you are to see this happen. But over all we are still on average for these kinds of incidents in the greater SL area. But it is kind of funny how KSL ALWAYS has to report on it and is usually the first one to do so.....

But this kind of thing may easily lead to requirements for more training to get your permit. The problem is that you cant legislate stupidity so they will punish all of us. So far in the couple thousand students FBMG has taught we have yet to hear of one of our students doing something stupid or getting into trouble. Thank goodness!

Ok, so I can't help but imagine the other story that was referenced. now I carry owb on a belt, speed holster. While going to the restroom, well yes the weight of the weapon can pull the belt out of the belt loops and flop to the side . Now Imagine this guy at a nice restaurant, in such a rush to "do the deed" he doesn't secure his weapon as he descends. It falls to the floor, one in the chamber, hammer cocked, and as he lets out a sigh of relief his muscles relax ,and BANG the toilet explodes! Now in a pool ceramic and raw sewage the realization of what just happend. Thats a bad day!
 
I contacted Kahr asking if it's possible for their guns to go off if dropped.

His response...only if the trigger was pulled or parts had been replaced by the owner.

We both agreed the guy that "dropped his gun" and shot the toilet probably grabbed at it as it fell.

Isn't that the crux of the issue? Why in the H-E-Double Toothpicks would you reach down and fiddle with your weapon in those circumstances unless it was to impress your lunch partner. "Oh, this pistol I am licensed to carry is so uncomfortable. Let me see if I can adjust it and lessen the pain from this great responsibility that I have for your protection. Doesn't this make me such a hero to you?"

This is the second one this week in Oootah. First was Monday night in Ogden when a Sandy man was showing off his Springer 1911 to his date and shot off his finger. I don't have the link handy, but he gave an account of fiction IMHO.

He claimed he unloaded the gun, and that as he re-inserted the magazine, the slide went forward causing the gun to discharge as his finger was on the trigger.

We all know that either he is covering up or he has a 1911 with a badly malfunctioning mechanism.

Same with the toilet shooter in Layton. That was a Kahr that supposedly drop fired...Excuse me? striker based weapon with a firing pin block had an AD due to the inertia of a drop? Not buying

At least in this case the offender was apparently honest about how this occurred.

Your ccw is private. Follow your momma's advice people. Don't play with your privates in public!
 
lol...maybe he reached down to discharge his weapon into the chair? perhaps i'm the only person who thought of this when it said that he reached down to do "something to the gun"
but really, i'm just happy nobody was killed.

look at the bright side, his lunch partner doesn't need to ask if is real, is it loaded or is your permit current...
