I went to a ca gun show recently and saw the new BX-25 magazines for sale at a couple booths. They were disasembled but in the original package. I asked the sales people if they were legal and they all said YES......
Question is; is it legal because they were not assembled or still illegal?

It's legal to sell the parts kits, it's not legal for you to assemble them into a working mag.

Nobody said California laws need to make sense.

They are sold as parts kits to repair existing magazines. Assembly of a newly imported magazine with a capacity greater than 10 rounds is a felony

They can also be used when the owner takes them out of state

That is seriously one of the dumbest laws I've heard of. A felony for that? Unbelieveable.

In Mass. you cannot buy bullets, ammo, gun powder, percusion caps, brass, etc without a state license but cross over into neighboring states, NH, Conn, NY and buy all you want without a license.

...go figure...

Never misunderestimate the creativity of the crooked and the stupid.
It gets worse in California. A LOT worse.

Yup. Welcome to California. :banghead: According to the link below, it looks like it could be either a misdemeanor or a felony. If you assemble it, illegal. If you take it out of state, assemble it, come back--illegal (importing). Give it to someone while it's assembled: illegal. Try to sell it while assembled: illegal. Anyway you slice it... :banghead:

More info than you probably care about here: http://wiki.calgunsfoundation.org/Large-capacity_magazine_restrictions

Lemme get this straight.

I have been holding a Para Hi-Cap pistol for a friend of mine who is in CA on orders, because he can't have hi-cap mags there. Are you saying that if I strip them down and put the parts in a ziploc, I can hand the whole package off to him?

Ah.... the bizzare waters of California firearms law.

Standard capacity mags can be legally owned here provided they were legally purchased prior to 1/1/2000 (burden of proof is on the prosecution)

"Rebuild kits" may be legally owned and used to rebuild existing magazines 100% - just don't end up with more magazines than you started with.

"Parts kits" may be legally owned (as long as they are never assembled in the state) taken out of state, assembled, used, disassembled and brought back in state in kit form.

or

"Parts kits" may be used to assemble legal 10 round magazines utilizing some sort of *permanent* block (permanent has never been defined by the DOJ).

You may not import, sell, manufacture or, assemble hi cap mags. However if you "find" one, like in the desert or in the trash at a range etc... it just might be legal, the law is somewhat unclear.

You may never ever insert an 11 + round magazine into a mag locked rifle without creating an unregisterd assault weapon.

...and the fun continues.

Can you take the parts set out of CA, assemble it at a range and shoot with it, disassemble it and bring the parts set back into CA?
Yes, completely legal...disassembled, it's just parts

Yup, just mail them to him.

You left off give and loan

Some guy I ran into at a popular Maine gunshop was from Mass. He had a High Capacity license that allowed him to own a "High Cap" magazine. He could own them but he couldn't buy them in Mass but out of state and bring them back is perfectly fine.

Pardon me while I pound my head into a wall and laugh insanely. We desperately need a straight jacket emoticon.

We're working on getting statewide CCW first, then targeting the rooster, before the magazine capacity limitations.

It is one step at a time
