So I am in Wal-Mart last night waiting to get my BP med script filled and decided to go check for ammo and see some .45 auto's on the shelf. Asked them for 3 boxes and happen to notice two Colt 6920 M4 Carbines on the rack. Decided to make my first Wal-Mart gun purchase. Been told I am on a 3 day hold?:what: Bought plenty of handguns from local gun stores over the years (one just this past Saturday) and never a hold?

Can anyone tell me am I screwed or after 3 days can I pick it up? It was a spontaneous purchase but seemed to be a decent price. I am just hoping I get it. I have my concealed carry permit, have for years but I don't think that matters or carries any weight here in Oklahoma. I am just wondering if anyone has experienced the same and if so did it turn out favorable and what options I have. Thanks, I appreciate the help.

It would be strange for place like Walmart to do, but the gun might be on hold for someone else for three days. If they change their mind you can get it. Some Walmart have site specific policies. For example, local WM which is located in bad neighborhood does not sell ammo after 10pm. Is the store you went to surrounded by trailer parks where poor white folks live?

Well they boxed the gun up and put my name on it and phone # and took it in the back. I called today and they said they still have heard no reply back yet. They said they will hold it for 30 days then it will go back on the shelf.

This is a rural Wal-Mart not a bad area at all. I am just wondering if they hear nothing back do I still get to purchase it? Never had this happen before. Always walked out with what I wanted the day I went to purchase it.

Well I pray it is just a mix up. I never invisioned myself purchasing a gun ever at Wal-Mart. Always been the type to support small business owners and local Gun Shops.

However after going to purchase a 500 round box of .22 ammo at my local gun shop in Tulsa and they told me they wanted $99.00 for it and I found the same at Wal-Mart for $23.00 I figured I would give Wal-Mart a try since this Colt seemed to be a decent gun.

So if there is not a response back on the background check am I cleared to purchase it or is that still up to Wal-Mart's discretion? I have heard some say Wal-Mart will not sell it unless they get the go ahead and other's say they can release it to you if nothing is denied.

The 3 day hold is the NICS...not Walmart. After 3 business days, Walmart can sell you the gun whether they hear back from NICS or not. Then again, they have the option of refusing as well. I wouldn't be surprised if they refused.

I just spent the last 2 1/2 days on delay for a Win 1987...first time I'd ever been on delay. Really annoying. The shop I got it at has a policy of refusing anyone after 3 days of no status change to the NICS.

Man, that is really going to suck! Never been denied ever. The guy right behind me came in and his went right through like mine always has. So I will most likely not get a reply back and they will not sell it to me. Then what? It goes back on the shelf for someone else? Could I try to fill out another background check at that point and try again or should I just go down the road and pay more somewhere else. This is really frustrating. So does having a PIN help at all to ensure it will go through everytime. Should I call or is there anyway to conct NICS or am I just going to be chasing my tail?

As stated above, after 3 days with no reply, the FFL can transfer the firearm; whether Walmart will do this or not is up to them. Background checks are taking longer than normal right now do to increased checks being performed. As for the UPIN, it would probably not help you. They are for people that have had denials overturned or people that are continually placed on delay which you've stated doesn't normally happen to you. If you do want to pursue a UPIN, you'll need to submit to a detailed BGC and be fingerprinted and by the time you get that back, your originally NTN will have expired
Just sit tight and wait it out.
Also, I don't know if you listed your SSN on your 4473 but that usually speeds up the process and helps stop confusion with someone else with a similar name.

The NCIS check is taking a full two weeks around here.

Does NJ have their own special NICS?

I bought a rifle with w NICS check recently. The call took maybe a minute... I listened to the store employee read off my information and confirm the "proceed" - there wasn't much of a pause.

Well just got a call to come pick it up. I always put my SS# and all info. Heck the one I bought the last two times took about 15 min max and I was out the door with a handgun. Did not think a Long Rifle would be an issue. So Thank God! I am heading out the door now to go pick it up even though I have no ammo to break the darn thing in with. Thanks guys for all the help and phychological support and counseling:) happy shooting!

Yes New Jersey has the State doing POC (Point of Contact) NICS. For some reason the state is insisting on that FFL's use FAXES for the NICS instead of them phoning it in according to a post that I read here on THR.

New Jersey residents are permitted get long rifles and shotguns in other states like, DE, PA and NY state of course they are required to have their FID or (Firearms Purchasers ID) Card.

Pistols of course can only be bought in the state (with the extra permit for each pistol and the one handgun per month rules).

Lucky dog! I get delayed all the time even with my concealed carry. I got a UPIN a month back and still got delayed! Plus, all the Wal-Marts around me don't sell guns because the paperwork is "too hard". You are definitely living the dream. :D

Just bought a Buckmark at Bass Pro Shops in Vegas, and the entire process took about 15 minutes filling out the paperwork etc. The thing that took the longest was getting my check to clear.;)

I thought having a CCL exempted you from having to do the NICS
check. Maybe that's just here in Texas.

This, of course, is their way of gun registration. They may not know which gun is purchased, but at least they have on file ALL of the information contained on the Form 4473. In New Mexico, as in most other (mostly) non-communist States, all the FFL calls in to NICS is name, DOB, and SSN.

Also, since the State is the original POC for the NICS check, it's possible the State is asking for, or demanding to know, the type of firearm purchased. This leaves them with all of your ID info, address, and firearm purchased. A simple firearms registration. The NRA should be all over this in Court.

Regarding WalMart, I have purchased several rifles from them (a #1, a 700BDL, a Savage Mark II, a 700ADL, a Marlin 336, and...... I know there's another or two. A neighbor in my neighborhood is the sporting goods Department Head, and he's told me more than once that WalMart gets the same guns (from their single dealer) that anyone else would get ordering from that dealer. In other words, they don;t get "rejects" or "special, (wink-wink) rifles or pistols.

I have no problem buying from them. I went to our only gunshop in my town. He sells, and will order for you, rifles and pistols for well over MSRP. Once when I showed surprise at a price he quoted me (on a Ruger #1), the owner stated to me that the reason his prices were so high is because of WalMart, and BudsGuns, and...... Implying that, if WalMart and other large retailers weren't "undercutting" him, his prices would be lower. Now, only an idiot would fall for what he told me. I like him and his shop, so I didn;t tell him that was BS.... that the only thing that would happen is, without the large retailers, you would have no way of comparing prices and realizing how high his prices were.

I understand that volume dealers can get better prices, but this is nothing new and existed long before WalMart came on to the scene. Remember when your local White's store was a local gun shop? Or maybe your Western Auto? (And no, in most towns they did NOT get volume prices. You could tell by the limited number of guns on the shelf). My brother in law worked in a small-town White's.

If it means I can save $200 on a rifle, I'll take WalMart or BudsGuns each and every time. I'd go to our Western Auto IF they sold guns (because I like these types of stores). BUT! If I really care to support my LGS, after my gun comes in from WalMart, I can always go over to my "LGS" and give him the cash that I saved from not buying at his store. That would be a nice gesture and in-line with supporting local retailers, right?

Now sometimes the price difference is neglgible. In those cases I don;t mind paying a little more and buying locally. But in my town's shop, the difference in prices on rifles and pistols is NOT neglibile, not in any fashion. So...he doeasn't get my business on his guns, except for used guns.

It works here in Kansas but the date of issuance has to be July 2010 or newer. Unfortunately, mine was issued in July 2009 so I don't get the proceed on a delay. My permit is valid, why can't I get a proceed? Makes no sense. Even went out of my way to get a UPIN. Worked with a long gun but didn't work with a handgun. :fire:

This happened to me last year,i had some extra money for once so i purchased several guns that i had wanted, this was within a 2 week time frame. About 2 weeks later i got a visit from the alphabet gang asking about my recent gun purchases and did i still have them and if so could they see them,i showed them the guns and they said thank you and explained that i had been flagged due to multiple purchases within a so called short time frame. Roughly 4 months later i went to purchase a handgun from my local FFL and i got put on hold even though i have NO criminal record and have a CCW permit,i did eventually get cleared a week later and was able to pick up my gun. My FFL told me they have seen alot of shady stuff like this going on lately and to avoid having to play the atf/fbi games they suggested i apply for my federal UPIN number so they cannot continue to delay purchases. I recommend this to anyone that gets delayed or denied 1x,there are a few reasons why you can get delayed/denied but just incase its good to get that number so it cant happen again.

Several people have said that UPIN hasn't prevented the delays....not to mention you have to get finger printed...NO THANKS
