Iowa HF2143 would exempt active military from getting an annual permit to purchase

Florida H0209 would add more exemptions to Section 1. Section 790.01 (carrying a concealed firearm)

Florida H7029 is the so-called 'pop tart' gun bill providing that students can't be disciplined

Tennessee HB2409 is titled the 'Tennessee Open Carry Firearm Act of 2014'

SB2477 is the companion bill to HB2409

HB2374 changes language in Section 39-17-1322 for justifiable use of force
 
HB4754 - Creates the offense of unlawful use of a three-dimensional printer to create a firearm. Provides that a person commits the offense when he or she uses a three-dimensional printer to create a firearm, or any piece or part of a firearm, unless the person possesses a license to manufacture firearms under the federal Gun Control Act of 1968

So there's your 'ghost gun' bill Trent :D
 
HB4715 concerns me. That's like the penultimate anti-gun bill.

You aren't kidding there. The entire time I was reading that this morning I was shaking my head.

But, while shaking my head I was thinking that a total registration like this (among the other nightmares in there) would probably be struck down as unconstitutional ... maybe not at the state level but probably at the federal level.

And this nonsense about having to show a firearms card for a gun that uses the type ammo you want to buy? REALLY? :fire:

Kentucky HB351 would allow anyone (not prohibited) that receives a restraining order to also receive a temporary license to carry

West Virginia SB498 would change current law providing for carry weapons in a vehicle without a permit

Georgia HB949 would allow the use of suppressors while hunting

South Dakota HCR1015 is a resolution rejecting the UN weapons treaty - they do realize it was never ratified right?

Alabama SB323 would exempt all firearms and accessories made (and kept within) in the state from federal law

Idaho H0472 would change law relating to carry weapons in a vehicle and other places

South Carolina H4628 strengthens state preemption laws

Missouri HB1778 has no text yet but the summary reads 'Prohibits landlords from prohibiting tenants from legally possessing firearms in individual residences or in common areas'

Maryland HB995 is a federal law nullification bill

Maryland HB997 would exempt the current transport of assault weapons, and detachable magazines laws from 'competition shooting or match shooting'

Yes, this is not unusual. Legislators will file a bunch of "shell" bills.

The "single subject clause" of the Illinois Constitution requires that bills remain on a single subject, to remain constitutional. It keeps someone from putting up a bill labeled "Health Insurance" when they are really trying to modify concealed carry. The bill has to remain in the same "subject" for it's entire course.

These Shell bills typically replace the word "and" with the word "and", etc. They'll file them on all sorts of generic subjects; so later on in the session, they can file floor amendments to modify them to something more specific.

This intertwines with another twist in the IL legislative system. Bills have a deadline to be introduced, and after that, no new bills can be introduced. However, existing submitted bills can be gutted and replaced with entirely new content via floor amendments at any point - which means ALL of those "criminal code" type of bills could *potentially*, and at *any* time, become anti-gun or pro-gun bills.

This makes it *incredibly* frigging hard to keep track of what is happening later in the session because each and every one of those criminal code shell bills must be checked daily to see if they contain a new "bombshell".

And there'll be hundreds of them by the time it is through. I'm actually compiling an additional list for 2/7/2014 for IL right now, there were a bunch introduced today.
 
Illinois Legislation 2/7/2014

New Senate Bills:

SB3010 Provides that nothing in the prohibition on carrying a concealed firearm into any building under the control of an officer of the Executive Branch of government, prohibits a licensee from carrying a concealed firearm onto the real property or building at a Department of Transportation rest area.

SB3018 Creates the offense of unlawful use of a three-dimensional printer to create a firearm. Provides that a person commits the offense when he or she uses a three-dimensional printer to create a firearm, or any piece or part of a firearm, unless the person possesses a license to manufacture firearms under the federal Gun Control Act of 1968

Senate version of HB4715:

SB3094 Provides that every person in the State must register each firearm he or she owns or possesses in accordance with the Act. Provides that a person shall not purchase or possess ammunition within this State without having first obtained a registration certificate identifying a firearm that is suitable for use with that ammunition, or a receipt demonstrating that the person has applied to register a suitable firearm under the Act and that the application is pending. Provides that the Department of State Police must complete a background check of any person who applies for: (1) a registration certificate for a firearm that was lawfully owned or possessed on the effective date of the Act, was brought into the State by a new resident, or was acquired by operation of law upon the death of the former owner; or (2) a renewal of a registration certificate unless, within 12 months of the date the renewal application is submitted, the applicant passed a background check conducted by the Department in connection with the applicant's acquisition of another firearm. Provides exceptions. Amends the Criminal Code of 2012. Provides that it is a Class 2 felony to sell or transfer ownership of a firearm to another person without complying with the registration requirement of the Firearms Registration Act.

This one isn't directly firearms but is weapons related:
SB3101: Amends the Criminal Code of 2012 concerning armed violence. Defines a "Category III weapon" as a bludgeon, black-jack, slungshot, sand-bag, sand-club, metal knuckles, billy, or other dangerous weapon or instrument of like character used by the defendant in a similar manner. Effective immediately.

SB3120 Amends the Firearm Concealed Carry Act. Provides that a person licensed under the Act has standing to bring an action in circuit court against a unit of local government challenging the validity of an ordinance or regulation of that unit of local government that purports to regulate any activities under the Act that are declared exclusive powers and functions of the State under the Act.

Kansas HB2578 would require chief law enforcement officers to sign & return NFA paperwork within 15 days of submittal as long as the person is not prohibited

California AB1609 would require all firearms purchased from outside the state to go through a licensed dealer, which is already law

New Jersey A2318 is a serious attempt at allowing law abiding citizens the ability to get a license to carry

Maryland

HB1199 would increase penalties for carrying a loaded concealed handgun

HB1325 is there own version of Florida's 'pop tart' law

That's exactly what we thought was happening but we wanted confirmation of it.

We have seen bills in other states that don't have your laws, where someone takes a appropriations bill and guts it and completely rewrites it into an anti-gun bill. All states should have the laws you guys have about this, even though it doesn't prevent some idiot like this from doing what he is trying to do.

Deletes provision that prohibits a licensee from carrying a firearm on a bus, train, or form of transportation paid for in whole or in part with public funds, and any building, real property, and parking area under the control of a public transportation facility paid for in whole or in part with public funds

Deletes provision prohibiting a licensee from knowingly carrying a firearm into a public park.

SB3229
Provides for the regulation of handgun dealers through licensure by the Department of Financial and Professional Regulation. Provides that no person may sell or otherwise transfer, expose for sale or transfer, or have in his or her possession with the intent to sell or transfer any concealable firearm without being licensed under the Act.

HB5428
Provides that the waiver of the applicant's privacy and confidentiality rights and privileges under federal and State laws only applies to records sought in connection with determining whether the applicant qualifies for a license to carry a concealed firearm under the Act

HB5443
Provides that a holder of a Firearm Owner's Identification Card which has expired, who is not ineligible for a Firearm Owner's Identification Card under the Act, and who has submitted the application and supporting documentation to the Department of State Police to renew the Firearm Owner's Identification Card, but has not received the renewed Firearm Owner's Identification Card within 30 days as prescribed by the Act is not criminally liable for any offense an element of which is not having a currently valid Firearm Owner's Identification Card.

HB5456
Provides that an officer or official paid or unpaid who has successfully completed firearms training as required by his or her law enforcement agency and is authorized by his or her agency to carry a firearm is exempt from the firearms training required for other applicants for a concealed carry license.
 
There's something to be said to living in Arkansas, were we do not have a full time legislature. They only meet every other year for a 2-3 month session. The Governor can always call a special session for fiscal emergencies, and there is a "legislative council" that is active while the legislature is not in session, but at least we don't have to keep our eyes out all the time for new bills that threaten to take away our rights.

West Virginia HB4472 is a preemption bill rolled up inside a federal gun law nullification bill that includes fines up to $10,000 fine for anyone trying to enforce the laws

Wyoming SF0109 would allow school districts to appoint teachers that have a carry license to carry on school property

New Jersey A2496 would authorize the hiring of retired law enforcement officers to provide security in public schools

Kansas HB2627 would exempt hunters from taking the hunter safety course if they have a license to carry

It exempts individuals;

7 (b) This Section does not apply to a person who makes
8 occasional sales, exchanges, or purchases of concealable
9 firearms for the enhancement of a personal collection or as a
10 hobby, or who sells all or part of his or her personal
11 collection of firearms.

However, it's still ugly. FFL's would have to:

#1 Must meet zoning requirements and provide proof
#2 Dealers can only transact business at the gun shop or gun show (which bans internet sales?)
(skipping some which just call for federal / state laws to be obeyed)
#7 No concealable firearm may be displayed in any outer window of the business premises or in any other place where it can readily be seen from the outside.
#8 All concealable firearms must be unloaded when delivered (uhh.. duh?)

And then we get in to the grit; the "reasonable precautions"

(10) The licensee must take reasonable precautions to
10 ensure that all concealable firearms that the licensee
11 sells will not be used illegally. These precautions
12 include, but are not limited to, the following:
13 (A) the refusal to sell a concealable firearm to a
14 person the licensee knows or has reason to know is
15 purchasing the firearm on behalf of another person who
16 could not legally purchase the firearm;
17 (B) the refusal to sell a concealable firearm to a
18 person who has provided a home address in a
19 municipality or county in which possession of that type
20 of concealable firearm is illegal, unless the
21 transferee presents reasonably satisfactory evidence
22 that the concealable firearm will not be used or
23 possessed unlawfully in that municipality or county;
24 and
25 (C) the refusal to sell a concealable firearm to a
26 person who has provided a home address in a
1 municipality or county that requires registration of
2 the firearm, unless the purchaser presents
3 satisfactory evidence of compliance with the
4 registration requirement.

And then the REAL nasty part. Registration.

Section 30. Submission to Department.
17 (a) A licensed dealer must, within 24 hours after making a
18 sale or transfer of a concealable firearm to a person who is
19 not licensed as a handgun dealer, submit a report concerning
20 that sale to the Department. The report must contain the
21 following information:
22 (1) the date of the sale or transfer;
23 (2) the identity and address of the dealer;
24 (3) the name, address, age, and occupation of the
25 transferee;
1 (4) the price of the firearm; and
2 (5) the type, description, and number of the firearm.
(b) All records of the reports submitted under this Section
4 must be maintained by the Department on a computer database
5 capable of allowing the retrieval of information for each
6 dealer and each transferee. [snip.. goes on and on]

It also includes 2 year RETROACTIVE mandatory registration for any concealable firearms sold in the 2 years leading up to the passing of the act.

And the kicker; screw up the paperwork? Go to prison.

Section 35. Penalty. Any person who sells, or who possesses
4 with intent to sell, trade, or transfer, any firearm without
5 being licensed under this Act is guilty of a Class 4 felony.

Tennessee SB2591 would change Title 39, Chapter 17, Part 13 to change the misdemeanor of carry a firearm, knife or club with 'intent to go armed' to apply only to those that are prohibited

I just contacted my NJ Representatives concerning this terrible bill, which makes it illegal to keep a loaded firearm in a safe in your home! Doing so could result in 18 months imprisonment AND a $10K fine! The...."representative" who sponsored this supposedly represents ME!

1. a. Except when lawfully carried on one’s person, a person shall not keep a firearm at the person’s abode, or any premises under that person’s control, unless the firearm is unloaded and:

(1) disabled with a trigger lock or trigger locking device as defined in N.J.S.2C:39-1; or

(2) stored in a securely locked box or container.

b. A person who violates the provisions of this section is guilty of a crime of the fourth degree.



2. This act shall take effect immediately.





STATEMENT



This bill would require persons who possess firearms in their homes to keep them unloaded and securely locked within the home when they are not being lawfully carried.

Specifically under the bill, a firearm that is not being lawfully carried must be unloaded and disabled with a trigger lock or trigger locking device or stored in a securely locked box or container. A violation of this provision is a crime of the fourth degree. Fourth degree crimes are punishable by imprisonment of up to 18 months, a fine of up to $10,000, or both.

Virginia HB114 removes 'private or religous' from law regarding prohibited places (schools)

H7483 would set up a 20% tax credit for the purchase of a gun safe for 2014 & 2015

S2390 would remove any possibility of parole for anyone convicted of possession of a stolen firearm

S2387 would remove the possibilit of parole for anyone convicted under 11-47-8 'License or permit required for carrying pistol -- Possession of machine gun.'

S2318 would add an additional 10% tax on all firearm and ammunition sales

S2377 is another bill removing the possibility of parole for person convicted of certain firearm related crimes

Michigan

HB5324 removes the section in current laws that exempts information from the freedom of information act

HB5328 also removes language from current law that exempts information from the freedom of information act

HB5327 would make all records relating to firearms exempt from the freedom of information act

Illinois

HB5605 would make it legal to carry a handgun while hunting as long as the person has a concealed carry license or is LE

HB5579 would make possession of a suppressor without a serial number illegal (which it already is)

HB5490 Changes unlawful sale or delivery of firearms to require waiting 24/72 hours to deliver the firearm after PAYMENT is made (not agreement to purchase, as it was previously)

HB5514 Provides that trapped beaver, river otter, weasel, mink, or muskrat may be killed with a .22 caliber or a smaller rifle. (wildlife code change)

HB5579 Makes suppressors "doubly illegal" if they are missing a serial #.

HB5605 Provides that a person with a valid concealed carry license issued under the Firearm Concealed Carry Act, or an off-duty law enforcement official or officer, may carry a handgun on or about his or her person while hunting.

HB5762 Strengthens penalties and sentencing requirements for felons and street gang members in possession of firearms.
