Supreme Court Grants Cert on Lautenberg

This case has nothing to do with the 2A or with the constitutionality of the Lautenberg amendment. It is simply a case involving the statutory interpretation of the language used in the Lautenberg amendment and the applicable TN statute. In short, the case involves whether the crime that the...

Driving Trip - Indiana and Illinois

That is a wideespread belief right now, but I respectfully disagree. There is no exception for nonresident vehicle carry in the UUW statute. Before you risk a felony, I'd advise you to consult an attorney if you plan to do this.

Has SCOTUS indicated that they want to grant cert on Moore v. Madigan?

SCOTUS has a lot on its plate. I highly doubt that a case in which a cert petition has not even been filed yet is even on SCOTUS's radar. They get hundreds of motions every month and this was just as routine of a matter as in any other case.

Huge news in IL (CCW, removal of Chicago AWB)

Here is the response from Shepard in opposition to Lisa Madigan's request for an additional 30 days. It's a very good read. Enjoy.

Huge news in IL (CCW, removal of Chicago AWB)

The plaintiffs filed a response this morning to Lisa Madigan's request for an additional 30 days to the stay of the mandate. I have attached that response.

We go over the cliff, at least temporarily.

Double that amount for me because I'll be paying for my wife as well. Unfortunately, the State doesn't offer a family plan discount. Edit: Just saw that Trent pointed out this same thing first.

Twenty state attys, several others file briefs supporting saf appeal

I agree that the Supreme Court would much rather review the Illinois case instead of the New York case, because the Illinois law is a straightforward ban. But, there is no guarantee that the Illinois law will be appealed, and after denial of Kachalsky, the odds of Illinois appealing to the...

Twenty state attys, several others file briefs supporting saf appeal

Very disappointing. The anti-gun crowd as well as judges will be emboldened to pass and uphold stricter and stricter gun control laws by this denial.

    Federal Preemption of State Laws

Yes, the federal government likely has the power to do this under the Commerce Clause.

Should someone who carries never get drunk?

Probably not. But a 0.02 BAC for a nondrinker like you would probably have a stronger effect on you than it would with a more frequent drinker.

Should someone who carries never get drunk?

Wearing a bulletproof vest would decrease the risk of being killed by a gunshot wound, but most people do not wear a vest out in public 24/7 because the discomfort and hassle outweigh the perceived reduction in risk, even though you never know when you might need a bullet proof vest. It's all...

Should someone who carries never get drunk?

I agree with you. It is odd to me that a person who enjoys occasionally drinking would give up drinking altogether just so that they will never be disarmed. If you really want to live, you've got to take some risks in life. You can hole up in the safe room of your house your whole life and...

    Sandy Hook search warrants released.

As others have mentioned, it's not likely we will ever get the whole truth regarding this situation. Because there is no criminal defendant, there is no criminal defense attorney working as a counter-balance to law enforcement to ensure that the investigation is done properly and the truth is...

    Antigunners getting discouraged?

There is clearly disappointment and discouragement by the anti-gunners. They feel like they have missed their chance to capitalize on Sandy Hook because the President and Congress moved way too slow. Now that poll numbers have returned to the pre-Sandy Hook levels, they know the opportunity to...

Traffic Stop has this ever actually happened to anyone?

I think the police are permitted to to take and secure firearms during the course of a stop to ensure their safety if they feel there is such a need. But, I'm not sure they are allowed to then run a search (without consent) on the serial number to see if it is stolen without having probable...

    Sandy Hook search warrants released.

I also thought it was interesting that the shooter had a copy of a New York Times article of the school shooting at Northern Illinois University. Supports my theory that the media coverage of these shootings results in copycats. I feel like if this kid lived 30 years ago, he would have just...

    Sandy Hook search warrants released.

This item: Exhibit #612 - One (1) holiday card containing a Bank of America check #462 made out to Adam Lanza for the purchase of a C183 (Firearm), authored by Nancy Lanza. Makes it seem that she was actively aiding him in his purchase of firearms. But then I realized there is no such C183...

    Sandy Hook search warrants released.

This was the most glaring new piece of information I learned after reading these recently released documents. Before, I think I had assumed that the mother owned some guns that she kept secured in the house, and somehow Adam got ahold of the guns and used them to kill her and the people at the...
