19 gun limit in NYS?

I was over at: http://forum.saiga-12.com/index.php?showtopic=2976&st=0 its a Saiga forum. This law was cited by a guy. Its the 19th or 20th post on that page. Is this REALLY a law in NYS?


265.02 Criminal possession of a weapon in the third degree.
A person is guilty of criminal possession of a weapon in the third
degree when:
(1) He commits the crime of criminal possession of a weapon in the
fourth degree as defined in subdivision one, two, three or five of
section 265.01, and has been previously convicted of any crime; or
(2) He possesses any explosive or incendiary bomb, bombshell, firearm
silencer, machine-gun or any other firearm or weapon simulating a
machine-gun and which is adaptable for such use; or
(3) He knowingly has in his possession a machine-gun, firearm, rifle
or shotgun which has been defaced for the purpose of concealment or
prevention of the detection of a crime or misrepresenting the identity
of such machine-gun, firearm, rifle or shotgun; or
(4) Such person possesses any loaded firearm. Such possession shall
not, except as provided in subdivision one or seven, constitute a
violation of this section if such possession takes place in such
person`s home or place of business; or
(5) (i) Such person possesses twenty or more firearms; or (ii) such
person possesses a firearm and has been previously convicted of a felony
or a class A misdemeanor defined in this chapter within the five years
immediately preceding the commission of the offense and such possession
did not take place in the person`s home or place of business; or
(6) Such person knowingly possesses any disguised gun; or
(7) Such person possesses an assault weapon; or
(8) Such person possesses a large capacity ammunition feeding device.
Criminal possession of a weapon in the third degree is a class D
felony.
 
(5) (i) Such person possesses twenty or more firearms; or (ii) such
person possesses a firearm and has been previously convicted of a felony
or a class A misdemeanor defined in this chapter within the five years
immediately preceding the commission of the offense and such possession
did not take place in the person`s home or place of business; or[/b]

I would read that as "You carry illegaly 20 handguns". Gun trafficking mesaure I'm guessing.
 
If you owned twenty guns in NYS you'd

(a) have an 'arsenal'
(b) be considered your own militia

Thank God I left that place when I did. Family still lives there, and they wonder why I never visit. :confused:

There is no limit on the number of firearms a person can legally own in New York State.

Section 265.20 explicitly exempts licensees from the provisions of 265.02.
S 265.20 Exemptions.
a. Sections 265.01, 265.02, 265.03, 265.04, 265.05, 265.10, 265.11, 265.12, 265.13, 265.15 and 270.05 shall not apply to:

3. Possession of a pistol or revolver by a person to whom a license therefor has been issued as provided under section 400.00 or 400.01 of this chapter;
In New York you cannot own a single firearm without a license. Possession of a single firearm is considered possession in the fourth degree...a class A misdemeanor.

The law cited is simply making unauthorized possession of 20 or more firearms a more serious crime. In this case, possession in the third degree...a class D felony.
 
Wow, absurd gun laws, high taxes, impossible rent, police brutality, the mob and Al Sharpton- NYC has it all!

Does anyone remember that famous NYC moment when Al Sharpton called Roy Innis an uncle tom on national TV and Roy went over and knocked him out?

The other good thing about growing up in NYC was that I remember Bernie Goetz. Does anyone else remember what Bernie is famous for? Hint: it involved a handgun, 4 black youths and the phrase "vigilante justice" uttered in a shrill tone. He walked on the murder charges but he served a little time for the pistol. He also got sued by the surviving muggers. Shame about that. They should have given him a medal.
 
Yeah 4 black kids armed with screwdrivers I think asked him for 5 dollars, which is an old NYC way of saying "give me your money." Since he was a skinny jew, they thought he would just cooperate so they wouldnt hurt him. Instead he pulled out a 38 and shot them all.

One died, one was paralyzed and the other two survived and are now in jail for rape and robbery respectively. He was acquitted of everything except the handgun charge and spend 8 months in jail.

At the time, much was made of the fact that he had an unregistered handgun and the muggers were black, which made people say it was a race crime. Much was made of the fact that he put an extra bullet into the now paralyzed guy after seing that he wasnt too badly wounded "here you dont look too bad, have another."

The NYPD also stopped pursuing vigilantes after the railroading the Attorney General in NYC gave Bernie Goetz. There were a number of high profile interventions on behalf of mugging victims that were never solved right after that. Cabbies also mysteriously developed the ability to wrestle the guns out of the hands of robbers and shoot them in self defense. Everyone knows that NYC cabbies arent armed.
 
my buddy had "Bernard always Goetz his man" in marker on his binder in Jr high.
i got a friend named goetz out here now, always laugh about that.

we all were proud of Bernie, even if he did overdo it a little.
the clincher was he got like (ok guy had better facts above me) , but for possesion of gun, NOT for shooting even with the famous comment.

its for people who are already in illegal ownership. like upping the charges if you have more dope. there are probably similar laws all over, or at least everywhere they ever busted a felon with 20 guns (haha)
 
No licenses or limits required

for long guns (except in NYC....which most of us that live upstate wish would fall off into the Atlantic Ocean...sorry NYC guys, but its true)...Need a permit for handguns, but no limit....My best shooting buddy has over 40 handguns on his permit (they had to add pages to it periodically,as there wasn't room on the little permit form he's required to carry).
 
There is no limit !!! Hell, I know a guy who promised me the pick of 12 long guns in his "collection" if I married his daughter. His collection is impressive, but his daughter is already seeing someone. If his daughter broke up, I'm on her like white on rice. :D

To further clarify the generally incomprehensible NYS gun laws:

"Firearm" does NOT include rifles or shotguns, only handguns and a few illegal types (machineguns, short-barreled rifles/shotguns, etc.).

"Possess" generally refers to on your person or under your immediate control, not so much in storage in your closet.

If you walk down the street carrying over 20 handguns, you're in trouble - and wierd.
If you have 100 guns in your closet, you're fine.
 
Many New Yorkers have many handguns. You register them all but you can have as many as you wish.

NYC is another kettle of fish and I make it a point to stay out of occupied America!
