Looking through each states proposed bills that are still alive and well in at least 5 different states legislatures, I have noticed that 5 states have proposed 2nd amendment preservation acts bills pending.
Oklahoma, Mo, West Virginia, Arizona, and South Carolina. There maybe another state that has as well if so my apologies for missing that state.
Reading the proposed Bills basically Oklahoma And Mo are for the most part word for word exactly the same, with a few minor changes. Not counting of course references to each states codes of course. The other three are totally different, with Arizona’s wording very short and sweet.
West Virginia’s seems to be for lack of a better word the most protective, the most intense. They go so far as to enable felony conviction possibilities for violating the act, as well as requiring the state AG go as far as defend a WV citizen charged with any federal crime that they (the state) determines is a violation of the 2nd amendment. They go so far to say that they will also arrest and prosecute any federal agent or federal employee as well. Although I could have misunderstood that part in all fairness.
I find it very nice to know that at least 5 states are attempting this type of legislation. Who knows if it will pass or not. While some parts might not stand up in court, and some states might be threatened with having certain funding cut off. It’s nice to know that some states will refuse to do anything about enforcing those federal laws and even going so far as to provide some level of penalties to those who do. Either civil &/or criminal penalties.
I do know several Texas state Representatives and State senators here in Texas are keeping a close eye on these states and what happens with these proposed bills. It is possible Texas in our 2021 legislative session that we could see a similar act proposed as well.
Anyone have any thoughts or opinions from a police / Legal point of view? If your a Leo, current or past, what are your thoughts if your state passed something similar to this. Or if your in one of these 5 states what are your thoughts? Good, Bad enforceable? Unenforceable?
