Montana Self-Defense Bill Pending in the Senate!

House Bill 228, the NRA-backed self-defense bill has been scheduled for a hearing in the Senate Judiciary Committee for Tuesday, March 17 at 9 a.m. in Room 303. It is critical that NRA members and pro-gun activists attend the hearing in large numbers as opponents will be sure to be out in force.

House Bill 228, sponsored by State Representative Krayton Kerns (R-58), is a broad piece of legislation that provides a number of specific protections for law-abiding citizens. The provisions of HB 228 clarify and expand the fundamental right of self-defense and protect law abiding citizens from undue prosecution should they ever have to exercise the right. HB 228 does the following:

Clarifies the ability of law-abiding citizens to carry a firearm in plain view and to display the firearm for harmless defensive purposes;
Allows a person who can lawfully possess a firearm and who doesn’t use it to commit a criminal offense to carry it concealed anywhere in the state without first obtaining governmental permission;
Prevents landlords and hotel operators from restricting law-abiding citizens’ self-defense rights;
Clarifies in statute the existing legal precedent that there is no duty to retreat from a threat before exercising the right to self-defense and allows a law-abiding citizen to use reasonable force in exercising the existing law that gives a private person the authority to arrest an offender;
Ensures that self-defense claims are adequately considered during incident investigations; and,
Shifts to the state, if self-defense is asserted by a defendant in a criminal case, the burden of proving an absence of justification.

My sister recently came back from working as a page (Someone who brings messages to and from representatives and performs other odd duties)in the house of representatives. She said that the representatives usually read all emails in original context. All phone messages are summarized by the secretary and printed and delivered to the Rep. but they are usually not read.

Your original message is more likely to be read if you email.
 
The bill is getting growing oppostion, see below. disappointingly, some of this opposition is coming from law enforcement. I think they should now better.

We need to act now. So even if your not from Montana, PLEASE, phone our congressman.

ELENA - Opposition is growing to the more gung-ho of the Montana bills aiming to expand gun rights - and is even fracturing the membership of the National Rifle Association.

House Bill 228 would let people carry concealed weapons inside of city limits even without a permit. It also makes certain that everyone has the right to self defense without an obligation to first run away.

The measure fairly easily passed the House, and received a Senate hearing Tuesday.

But law enforcement officers and prosecutors - including several who touted their NRA credentials - say the bill goes to far and creates loopholes for criminals.


I would be interested to hear just what these loopholes are?

These people work for the citizens, through the State of Montana and its municipalities.

They should have no right to speak as anything other than citizens, when it comes to supporting or opposing a law. I.e. political statements starting with "I'm a cop, and..." should translate to "Pink Slip."
 
The Inter Lake today ran an AP story that "the House-Senate conference committee largely accepted the version that cleared the Senate - which had the blessing of police and prosecutors - and prepped the bill for what appears will be easy final passage."

No loopholes, just rhetoric designed to scare those who still think the "criminal" is shrouded in mystery.

Criminals don't need loopholes, because they don't intend to even try to obey laws (duh, they are criminals). Loopholes are for people who generally intend on obeying the law, thus they look for a "loophole" to use in justifying behavior that others might argue was illegal. Criminals don't care. They carry concealed legal or not. They rob, murder and rape, no loophole needed.

ArmedBear, I agree with your statement. Anytime these officials comment on stuff along these lines they should either be severely reprimanded or given the boot! They have no right, working for us, and using their jobs and their positions as a political platform to voice their opinions from. We used to get in serious trouble if we voiced political opinions when I was in the military, they should have to suffer the same repercussions in Law Enforcement!!
As for politicians, we know they don't act within our best interest! As soon as they get elected, they forget who put them where they are!!

It's confirmed. The Governor signed HB 228, our Self Defense bill, this morning. The fat lady has sung, and it's time to celebrate.

There are a lot of people to thank for the passage of HB 228.

First, thanks to all of YOU for your staunch support. Thanks for traveling to Helena to testify, and thanks for the avalanche of messages to committee members and other legislators. Legislators report that they received more messages in support of HB 228 than for ANY other bill, ever. YOU made a difference!!

Second, thanks to sponsor Rep. Krayton Kerns (R-Billings) for doing a great job of carrying the bill. He invested a LOT of effort in HB 228.

Third, thanks to the NRA for (finally) supporting this landmark legislation. The NRA was fully onboard and fully engaged this session, especially the NRA State Liaison for Montana, Brian Judy who has long been a friend to Montana gun owners, even when the NRA in D.C. was hanging back.

Fourth, thanks to Rep. Deb Kottel (D-Great Falls) for her heroic support of HB 228, in both the House and Senate. Deb's support made a LOT of difference and showed some other Democrats that HB 228 was NOT a partisan, party-line issue, but a "people" issue.

Fifth, thanks to all those other legislators who enthusiastically supported HB 228 and never wavered on the principles involved.

Sixth, thanks to those brave law enforcement professionals who bucked the current and came out publicly in favor of HB 228

Finally, thanks to Governor Schweitzer for signing HB 228, both for doing what he promised in MSSA's Candidate Questionnaire, AND for being a true Montanan by supporting HB 228.

BTW, thumbs down for the few law enforcement administrators and prosecutors who are so afraid of armed citizens that they lied and claimed end-of-life-on-Earth in opposing HB 228. You need to work locally to replace these people. They just don't have a Montana attitude.

I'm just gonna start supporting Montana's RKBA as an out-of-stater, because the more I read about the political happenings of the state, the more I convince myself that I will move there. :)
