--- KEEP AN ANTI-GUN JUDGE OFF THE UTAH APPEALS COURT!

Anti-gun rights Judge Robert K. Hilder is being considered again for promotion to the Utah Court of Appeals. The Senate Judicial Confirmations Committee held up his nomination last week and will make a final vote on Wednesday. He was rejected in May, 2005, and he should be rejected again now! Tell the Committee to reject him!

Hilder is notorious as the judge who upheld the University of Utah's ban on legal self defense weapons on campus. This was despite the obvious plain language of Utah law, and a thoroughly researched official opinion from the Attorney General's office, which the University of Utah challenged, ending up in Hilder's courtroom.

Hilder's ridiculous ruling in September, 2003 was made orally, with NO EXPLANATION AT ALL, a most unusual action, unless there was no legal or rational basis for his decision. Worse, after he made his ruling, he recused himself from any further consideration of the case, another highly unusual maneuver. More expensive and unnecessary litigation was required before Hilder’s bad decision was finally thrown out by the Utah Supreme Court.

Also, as a member of the Utah Judicial Council, Judge Hilder acted to prohibit courthouses from installing gun-storage lockers for legal self defense weapons, as required by state law. There is no doubt that Hilder is hostile to individual self defense rights protected by Article 1 section 6 of the Utah Constitution and the Second Amendment to the U.S. Constitution.

This is not a man who should be sitting in ANY judicial position, let alone be promoted tot eh Utah Appeals Court!

Hilder has been involved in other actions which raise doubts about his judicial temperament, and ability to render impartial justice based on the facts and the law. Sources cite water rights cases that are problems. Also, some people blame two deaths on Hilder’s controversial actions. In 2004 more than 60,000 votes were cast AGAINST his retention in office as a Judge.

ACTION REQUIRED:

ASK THE SENATE JUDICIAL CONFIRMATIONS COMMITTEE TO VOTE AGAINST APPROVAL OF HILDER'S NOMINATION! Please email, fax or call IMMEDIATELY, and no later than Tuesday evening because they will be meeting on Wednesday morning!

I am writing to OPPOSE the nomination of Judge Robert K. Hilder to the Utah Court of Appeals. Find someone better qualified for the job.

Judge Hilder has shown by his performance that he lacks the judgment and temperament to serve as an appellate judge.

Specifically, Judge Hilder demonstrated an overwhelming hostility toward the Constitutionally protected right of legal self defense, and a callous disregard of the clear language of the Utah statutes prohibiting the University of Utah from enforcing gun bans in defiance of the Utah Legislature.

His judicial activism in favor of the University of Utah's ludicrous claims was inexplicable. Worse, his failure to provide anything more than a summary oral decision, with NO explanation in this high profile case, forced a costly and unnecessary appeal before his bad decision was thrown out by the Utah Supreme Court.

Also, in 2003, Judge Hilder, as a member of the Utah Judicial Council, voted to disobey the new Utah law which required courts to install gun-storage lockers outside the court's security perimeter. This is further proof of his bias in favor of judicial activism and hostility towards law-abiding gun owners.

More than 60,000 people voted against retention of Judge Hilder in 2004, demonstrating a significant lack of confidence in his performance as a sitting judge.

Utah deserves judges who faithfully, fairly, and consistently uphold the Constitutional rights of our citizens, and enforce the law, and do not engage in judicial activism to advance their personal agendas. Hilder fails to meet this minimum standard, and should not be nominated. There are other well qualified people available.
