Lancaster man will not face charges in shooting death

LANCASTER - A 73-year-old Lancaster man will not face charges in the fatal shooting of a man who investigators say stalked his wife and threatened to kidnap her child.

Jim Ragsdale was aware Monday night that his wife, Claudia, 23, had been stalked by a man whose name has not yet been released by the Sheriff's Homicide Department, investigators said.

The man would show up at Claudia Ragsdale's out-of-town workplace and had threatened to burn down the couple's house down with them in it and to kidnap Claudia Ragsdale's 1-year-old child and take it out of the country, investigators said.

"This guy made a nervous wreck of my wife," Jim Ragsdale said.

Only hours before the shooting, the man allegedly tracked Claudia Ragsdale down at her work and again made threats. She reportedly asked a friend to go home with her.

After they arrived at the Ragsdales' home in the 44700 block of Tarragon Drive, the man reportedly knocked on the door. Claudia Ragsdale's friend told the man to leave.

A second knock reportedly prompted a gun-toting Jim Ragsdale to go to the door and tell the man to leave. The man allegedly continued to make threats and moved toward the family. Ragsdale reportedly told the man not to come any closer.

The man allegedly came closer and shoved a hand in one of his pockets. Ragsdale said he shot him once in the head, killing him.

"As the old saying goes, give your soul to God, but come on my property and your *** belongs to me," the ex-Marine said.

Ragsdale was arrested, but Deputy District Attorney Greg Denton on Thursday declined to file charges against the man because he did not think that he could prove the shooting was not in self defense.

"We would have to prove that he was not acting in self-defense or the defense of others and we can't prove he wasn't," Denton said.

And there is at least on prosecutor in California that does not reside with his head firmly implanted up his anal orfice.

The fact that they woul;d attempt to try is what bothers me. In Colorado, he would be told to simply stand back while we get this trash out of your home for you. Thank God for the "Make my day" law.
 
We need to send this one to the NRA for the magazine's "Armed Citizen" column.

I live in Lancaster and didn't even hear about this. Guess I'll have to read the local paper more. 73 and 23? I get the feeling that there's more behind the story. If I was him, I would be looking more closely at who my wife knows or what's she's been doing (or who for that matter).

The PDRK has a similar law. I think an overly enthusiastic peace officer chose to ignore the law and arrest him. The district attorney's response is appropriate as the PDRK law presumes the homeowner was in fear of his or his family's life.

OT a smidge - how many cases have I seen where huge exhonorating evidence is found, even the real perp - but the DA prosecutes the oh-so-obviously not guilty guy just to save face.

Sounds like a tough old coot this one - hafta be to have a 1 year old at 73. I'm not yet 33 and mine runs me ragged.

Prosecutions are considered "wins" and "wins" are what gets you a shot at being the District Attorney instead of being a Deputy District Attorney for the rest of your days. The more high profile the case the better; but if it gets too high profile, like the O.J. case, you will be co-opted by the D.A. and he will get all of the face time, like Ira Reiner did in the O.J. case. You'd think that he was the one who tried the case, and won, to hear him speak of it.
 
Ummm if I was a cop and I arrived on the scene of a shooting where only one person had a gun, you can bet that I would take that person into custody until the DA decided whether to press murder charges. Its a completely understandable and prudent move on the part of the cop. Hopefully Ragsdale doesn't get sued into his grave by the stalkers family.
