Can I Keep My Lower Waiting for SBR Stamp

I've got all my forms signed by Sheriff and Printed for an SBR and Silencer, can I purchase a 16" complete, use that lower to register on my Form1 (with SBR Length say 11.5") and use the legal assembled gun 16" until I get approval then purchase and install the short barrel or must the lower stay at my dealer?

Yes. You can keep and use your lower as a normal "Title I" rifle until you get your Form 1 back.
 
Yes but I prefer to build them as a pistol before sending it in so I know everything works. Then when it comes back just swap out buffer tubes and add a stock.

This makes no sense. He says he's already got forms signed - and he has yet to own a rifle.

How do you have a form ready to go to ATF for an a modification to a gun that you haven't even taken into possession yet?

I'm not sure I see the problem. It's a bit unconventional, but he's filing a form to "MAKE" a firearm. It isn't technically a form to "modify" a firearm. As far as the BATFE is concerned he can be milling it out of steel stock.
 
My money is on he has a stripped lower.
No, read the original post carefully. He's asking if he can buy a 16" complete [rifle], and use the lower receiver of that as the basis for the SBR he's "building" on a Form 1. Or, does that lower, which will be engraved with the SBR info to match whatever he puts on the Form 1, have to stay at his dealer's shop until he gets the Form 1 back.

He can take the rifle and use it as a 16" carbine until he gets the Form 1 back approved, then he can slap his shorty upper on it.
 
Yup! All he's really doing on the Form 1 is telling the ATF what he's planning to build. It really doesn't matter if he's mining iron ore and planting walnuts to make his own raw materials from which he'll whittle a gun :)D) or, as is more common, starting with something that's already a functional Title I rifle and "Making" a Title II weapon from it.
 
Sam's got it right, I got a Form1 filled out (except lower details) and signed off by Sheriff for the lower SBR and a Form4, same deal for a suppressor, which will have to go to a Class3 Dealer and be completed with my suppressor purchase.
Thanks for the help guy's, off to an Atlanta Show Saturday to try to find a good set-up.

. How did you get a form 1 approved without a ser #? Maybe I should just start sending in f1'S for machineguns every week until one gets approved.

Edit:Oh, looks like you have it but not sent in in to the BATFE to be approved yet.?
 
Right j, I have it all signed off by the Sheriff, along with print cards, I just need to make the purchase, finish the form and send it off for approval. We've got a good Sheriff here, he was very helpful when I met with him.
