Howdy all, I just registered here in order to try to get an answer for something that's been on my mind for a couple months, I really hope I got this post right;

I currently possess multiple legal semi-automatic rifles and shotguns, and a SW model 29, yet these firearms are not in my name due to me being only 16 years old. I am not new to handling firearms and such.

Just as a basis, I live in NC and I recently purchased my first vehicle, a motorcycle, after getting my motorcycle license. I keep the thought of it in the back of my mind at all times since I'm worried someone may try to steal it or key it and so-forth due to me living in a crime filled area. My question is, is it legal to carry my UNLOADED sw29 in a locked guncase, inside of my backpack when I go riding, and to have ammunition lets say, in a whole other pack, just to keep them separate.

You probably have a good idea why I would want to have a weapon on me, yet for legalities sake I want to transport the firearm. God forbid I would ever have to take it out of its case. Either way I want to carry an unloaded handgun in a locked case inside of a bag, and ammunition for said weapon on my person in another bag whilst I ride into "safety-questionable" places. Is this legal?

ALSO I would like to address that this weapon would only ever be outside of its locked case in a life threatening situation for me to use to defend myself accordingly.

Let's keep this thread on track or it will be closed -- so

1. We're discussing the legality and not the wisdom of what the OP wants to do.

2. The OP lives in North Carolina, so we need to stick with North Carolina law.

3. Opinions which aren't supported with reference to the applicable law aren't helpful.

I found this and it doesn't look good for the OP. Please check out the entire thread at http://www.ncgunowners.com/forum/showthread.php?tid=22162

This is for car carry but I don't believe motorcycle carry is any different.

"RE: Car carry for 16 year old
Not a lawyer but a 16 years old MINOR without an adult equals bad juju.

§ 14‑269.7. Prohibitions on handguns for minors.

(a) Any minor who willfully and intentionally possesses or carries a handgun is guilty of a Class 1 misdemeanor.

(b) This section does not apply:

(1) To officers and enlisted personnel of the Armed Forces of the United States when in discharge of their official duties or acting under orders requiring them to carry handguns.

(2) To a minor who possesses a handgun for educational or recreational purposes while the minor is supervised by an adult who is present.

(3) To an emancipated minor who possesses such handgun inside his or her residence.

(4) To a minor who possesses a handgun while hunting or trapping outside the limits of an incorporated municipality if he has on his person written permission from a parent, guardian, or other person standing in loco parentis.

The following definitions apply in this section:

(1) Handgun. – A firearm that has a short stock and is designed to be fired by the use of a single hand, or any combination of parts from which such a firearm can be assembled.

(2) Minor. – Any person under 18 years of age. (1993, c. 259, s. 1; 1994, Ex. Sess., c. 14, s. 5; 1993 (Reg. Sess., 1994), c. 597, s. 1; 2011‑183, s. 9; 2011‑268, s. 6.) "

I DO NOT see anything where it says unloaded and ammo separated. Although that maybe somewhere else. The above mentions Possession.

Additional Info

Warning: Found this...

"Additionally, North Carolina prohibits any person from causing, encouraging, or aiding a minor who is less than age 18 to possess or carry, whether openly or concealed, any firearm on educational property. Moreover, North Carolina imposes a felony on any person who sells, offers for sale, gives or transfers in any way a handgun to a person under age 18."

I hope this helps.

Well shoot, thanks anyways guys. I'm just gonna have to be extremely careful it looks like. Appreciate people actually commenting.

A handgun locked in a case wouldn't do you any good as a defensive tool anyway other than as a hard object to smack the bad guy with. There's lots of better options than a handgun case to use for that purpose if you need to.
