Change in Illinois waiting period...?

Has anyone experienced a recent change in the 3 day mandatory wait to pick up a handgun? I completed the paperwork for a pistol on Thursday and casually said "See you Monday" for the pickup. The FFL pulled out a spring '06 BATF flyer noting that the waiting period begins, not with the NICS phone call but at midnight of the day the call is made. Further, Sat, Sun and holidays do not count as part of the mandatory wait. The attached chart showed that paperwork on Thurs = possession on the following Wed. So the 3 day wait from Thus is now calculated as all Fri, Mon and Tues.

In the last 2 years all my purchases were timed at exactly 72 hours from the initial call in to NICS....anybody else encountered this?

That is an interpetation of the law discussion.
I'll bet most shops that know the customer will continue to allow 72 hours from point of purchase.
If they don't know you, you may just as well add an extra day.
 
when I picked my M9 up, it was the same thing. The point from when the paperwork was signed, + 3 days not including Sat/Sun. :confused:
 
I'd have asked them to show me where Illinois law says it starts at Midnight. I lived there for over 22 years, and I NEVER had that problem. Of course, during the time I worked as a Security officer/PI, I didn't have to wait either. All I had to do was show my blue/green/tan/(Whatever color it is now) card and my company issued ID, and I took the gun home the same day.
 
I am so tired of this damn state. I really think this is reidiculous. I would not blame the gunshops for this as they are probably just complying with what they are told by the people at NCIS. I think it is more the fault of the government.

One would think that the FOID card would allow us to bypass this issue.
 
The people at NCIS have no control over the waiting period in Illinois. NCIS is federal (unless the state has it's own NCIS setup, some do, most do not). The only thing NCIS tells them is either go ahead, wait, or don't sell. If it's a "go ahead," then the dealer can complete the sale, of course in PRI, you still have to wait 3 days for a handgun, since it's a "cooling off period."

While we have to have handguns "safety inspected" in Michigan, at least we don't have to wait, if NCIS says "go ahead." In fact, as of March of this year, any CPL (Concealed Pistol License) holder, who's license was issued on or after Nov. 22, 2005, now serves as a substitute for the NCIS check. Meaning, of course, if you have one issued on or after that date (as I do. ;) ) then when you buy a gun, and show your permit, the dealer doesn't need to call NCIS. :D

Sometimes I hate this state, and other times, I just love it to death. :D
 
I think it must be the shop . .just bought a new .22 pistol for my daughter on Thursday and they said I could pick it up on Sunday (if they had been open)

3 days, that's it? You guys got it nice, we have to wait 10 (ten), that's right, 10 (ten) days from time of purchase (Sat. and Sun. included. 10 (ten) 24 hour periods from time of DROS (Dealer Record of Sale). This is not just for the first gun, this is for every gun, long or pistol, and one new gun purchase a month (You can buy Private Party Transfer all you want, aka USED).

On top of that, we have a "safe handgun" list we're forced to deal with on new purchases, but LE is exempt, how ironic they can shoot us with unsafe guns LOL. That sounds like a lawsuit to me.

PRK gun laws suck, but we're working on it.

HAS to be the dealer, so far as I know, there's nothing in the Illinois law that says Saturdays and Sundays don't count.

It's generally 3 days, and if the gun dealer is open on Saturday and Sunday, then they count.

At least, that was my experience 5+ years ago, when I lived in the Peoples' Democratic Republic of Illinois. ;)
 
Illinois does it's own NICS check, and that is another of our problems here. The federal check is destroyed within 24 hours after being approved, our friends here keep it forever. I don't remember when it seemed to change but Saturday and Sunday used to count but now they only count if the store is open on weekends. Also, even private sales are subject to the waiting period. My most recent purchase here in Illinois was only about a month ago. The three day wait included the weekend, and exactly 72 hours after purchase I was able to pick it up. The store has a policy of not letting a customer walk the gun out of the store unaccompanied. The clerk carries the gun to the door and then hands it to you. I don't see how that really makes anyone safer.

As I said, the dealer showed me the flyer and it was from Spring of this year...so, things may well have changed. I'll try and get a copy when I get the gun on Wed.
This particular guy is not open Sun but I would previously have expected to get it on Mon at the latest.

Who knows? The state police are in charge of such things and are extremely anti-gun. it would not surprise me at all if they snuck something like this in adminstratively.

I have not run across it since the last handgun I bought the waiting period did not run across a weekend.

It is a minor nuisance in the overall scheme of things. I find it ironic that after you wait 30-180 days for your FOID card to show up, you then have to wait 3 or more days to pickup a firearm. if the month long cooling off period did not cool you off "enough", an extra couple of days will not help any.
 
Can you plan ahead?

Can you fill out the paperwork when you pick up gun #1 and then next month, or when the bank account recovers, go in and buy and take possession of gun #2?
And fill out paperwork for gun #3.

I'm not sure if that's strictly legal but it is certainly common once the FFL holder knows you. Some, mostly retail store operations, insist upon having the new gun's serial number and the gun in hand before they'll perform the check, even though it is not needed legally - individual FFL policy.

Added BATF bonus - 2 NICS checks for an individual in the same week requires an extra form be completed...after all, planning on buying 2 guns indicates you don't just need a "cooling off" period - you must be seriously deranged and need to seriously chill out!

The last handgun I bought was from a dealer I had allready bought several handguns from and they had to order this one, S&W 625JM. I did the paperwork when I ordered it that way my "waiting period" was over by the time it came in. They told me that legally they do not need the serial number and the call just gives either long gun or handgun.

Our governor vetoed a bill that would have eliminated the waiting period when trading in a "working" handgun for another. IIRC his reason was that someone might be trading in a gun so they could have a more powerful and more deadly one. Of course the real reason is just that he is a gun hater and puppet of Mayor Daley.
