1. The relationship between the victim and the defendant is one of marriage or former marriage or of persons residing or having resided in the same household.
2. The victim and the defendant have a child in common. . . . .

OK lawmakers said:

Any person who commits any assault and battery against a current or former spouse, a present spouse of a former spouse, a former spouse of a present spouse, parents, a foster parent, a child, a person otherwise related by blood or marriage, a person with whom the defendant is or was in a dating relationship as defined by Section 60.1 of Title 22 of the Oklahoma Statutes, an individual with whom the defendant has had a child, a person who formerly lived in the same household as the defendant, or a person living in the same household as the defendant shall be guilty of domestic abuse.

A federal court found Chad Wayne Kaspereit guilty of two counts of lying on form 4473. He lied twice on Form 4473 by falsely claiming he was not under a victim protective order.

:Kaspereit, 34, of Duncan, received the conviction by a jury for possession of firearms while the subject of a victim protective order — a document issued by a court after a victim is abused, stalked or harassed ordering the pursuer to stop doing so or be punished — and for falsely filling out a federal form to purchase firearms, according to the United States Department of Justice. The charges stem from an investigation by the Bureau of Alcohol, Tobacco, Firearms and Explosives in conjunction with the Cleveland County District Attorney’s Office and the Oklahoma City Police Department. Assistant U.S. Attorneys K. McKenzie Anderson and Jacquelyn M. Hutzell prosecuted the case as part of Project Safe Neighborhoods, a program focusing on violent crime reduction efforts through the Department of Justice.

“This office aggressively enforces the federal prohibition against possessing a firearm while under an active victim protection order,” said First Assistant U.S. Attorney Troester. “This case and others like it will protect victims from further abuse and protect law enforcement officers who respond to domestic calls. I want to thank the Oklahoma City Police Department, ATF, the Cleveland County District Attorney’s Office, and especially the prosecutors in my office for working together to seek justice in this important case.”"

Good on the federal prosecutor.
I’m his father and he has never been convicted of any missed in use or anything else besides this . Also I would point out where is the po paper work cause he never had a hearing on it and there was no po order at the time he brought the guns . He even call his lawyer before he bought them and lawyer said your good to go . So before you past judgement get the whole story for this is a expensive fight for my family to finally show the truth he was use as a post child for there program we are in the process of new hearing or acquit . For the true was not told that’s the power of the government. He never stocked or harassed or anything else to his ex-wife . He never had any record what so ever . I will be glad to show anyone the records to show what I said

With that said, I will suggest that you might want to visit with your son's lawyer before posting any details about the case here. The lawyer may not want you doing so, and it may be in your son's best interest to avoid it.

Yep, according to some on these gun boards wives and girlfriends often lie. Let's forget about the guys who beat their wives and kids. :neener:

Many years ago when I worked for a bondsman. I would bond fellas out for assault on a female. 90% said there wife/girlfriend took Xanax and flipped out. Now I'm sure alot really did hit them. But how many are locked up for lies? And lost rights?
