Rep. Peter King (R-NY) has introduced the companion version of the failed Schumer-Toomey-Manchin bill in the House. H. R. 1565 "The Public Safety and Second Amendment Protection Act." This bill currently has 185 co-sponsors - and when you see who is signed on, it should be clear this bill does not protect the Second; but attacks it. The bill is 33 votes short of a majority in the House. While it is unlikely House leadership are feeling suicidal, you might wish to contact your Representative - especially if they are one of the co-sponsors below:

The former has so many holes in it that it literally invites interpretational mischief. [Gov't now gets to define "friend"?]

Criminals will still not have to do background checks, because they will only sell/transfer to their … "family and friends", yeah, that's the ticket!

Key Benefit: Cuts off access to firearms by criminals and dangerous individuals: Over 6.6 million guns are transferred each year through private transfers not subject to background checks. Criminals exploit this loophole-nearly 80% of those incarcerated for crimes using handguns obtained their guns through private transfers.

The 6.6 million "private transfer" estimate is probably from the National Survey on Private Ownership and use of Firearms, which sampled ordinary citizens. This is the source of the much used 40% statistic of gun acquisitions not through licensed dealers; UBC would apply to NSPOF average citizen gun survey fractions of:
13% purchase from non-dealer (private sales, used guns)
19% gift from family or friend
3% trade or swap used guns
5% inheritance
(Of NSPOF's 40%, only 16% would fall under the UBC requirement.)

The 80% of inmates obtained their guns from private transfers is from a survey of prison inmates.

I "love" the mismatch of projected count of private gun transfers from ordinary citizens with the percentage of inmates acquiring handguns. Honestly, even Robert Sherrill estimated crime represented 1 of 400 guns at most.

Universal Background Check would apply to Bureau of Justice Statistics state inmate gun survey fractions of:
20.8% from drug dealer/street
18.5% by rent or borrow from inmate family or friend
12.8% by purchase or trade from inmate family or friend
9.9% by theft or burglary
8.4% from fence/black market
8.3% other acquisitions from inmate family or friend
(BJS 78% of gun acquisitions from such "private transfers" to criminals.)

Question: would the inmate listed sources comply with a UBC? Voluntarily go to a gun dealer and pay to have the gun dealer run a background check on the buyer?

Exemptions: The bill would exempt transfers of firearms between friends and family from background check requirements.

Friends of inmates are often fellow criminals, as are many family members of inmates. But they will be exempt? BJS state inmate gun survey fractions of private acquisition from family or friend:
18.5% by rent or borrow from inmate family or friend
12.8% by purchase or trade from inmate family or friend
8.3% other acquisitions from inmate family or friend
(BJS 39% of inmate gun acquisitions from "private transfers" from family or friend.)

How many criminal acquisitions will be "cut off"? How much money and law enforcement resources will be spendt on background checks on millions lawabiding citizen selling, trading or swapping used guns? Another nurden on the law-abiding that will be ignored by the criminal element, and money an resources diverted from projects that may actually affect criminal behavior.

Recent events have led me to conclude that the politicians that push these things are NOT doing this because they are dense or clueless. They know exactly what they're doing. The end game always seems to be confiscation. Look at the recent thread about California going out and taking guns from people who are suddenly on the "prohibited list".

The lawmakers pushing these laws aren't clueless but they're counting on the ignorance and emotional irrationality of the general public in order to move closer to the end goal (confiscation).

Geez, I sound like a conspiracy nut, but lately it doesn't seem too far-fetched given the crazy things the people in power do. Bloomburg's soda ban anyone!?

I assume this is the same Peter King who said that anyone who buys a large quantity of nails , should be reported to the police. Define large, more than one nail? 10 nails? a box of nails?

Those sponsorships were 6 or 7 months ago...after the failure of the "first" bill to go anywhere in the Senate.
 
Well it seems numerous of the useless bed wetters from Texas signed on to it. No surprises here. That's all I needed to know to see it is totally worthless legislation. They got their hands spanked once but didn't learn any lessons. Probably never will.

Now sort them by political party, and the obvious should become clear... :uhoh:

Never-the-less, all of them will be up for re-election in 2014, and if you live in a district which any of them represent, drop them a letter and tell them that you will remember their endorsement of this bill when you vote for someone else next year.

A heavy mailbag can carry a lot of weight. :evil:
