how do you protect yourself in your vehicle or just driving down the road. im going to be in CA in september for school an was looking into the laws (cant bring my 9mm cuz i dont have 10rds just 15rds mags) an you cant even have the weapon out. has to be locked in the trunk! what do you all do?

carjackings, infringement of rights, your right though a hasty escape is probably better. still its just the fact of how oppressive it is. that an you really have to look into those laws if not you could accidently commit a felony an not even know it. like my hi-cap mags. bringing those in even with no intent to sell would bring me up on importing charges. what if it to death if i get pulled over for speeding and get searched im screwed in a few ways. im almost to the point where i figured why even bother bringing my pistol with me. as soon as you think like that they won.

Technically true, but in reality, unenforcable. If your high-caps are legal prebans, there is no way to know if you bought them legally here in kali before the ban went into effect. They don't have serial numbers, so they are not traceable.. You could claim you ordered them three years ago when you stayed here for two weeks visiting yout cousin and they couldn't prove otherwise. The only people who will get fried for sure is anybody who has "LE ONLY" high caps made after the ban in their posession. I don't recommend bringing in high-caps, but the chances of you getting busted are about zero unless you tried to sell them to somebody.

Handguns do not have to be locked in the trunk under California law. They merely have to be in a locked container. A lockable case, duffelbag, etc. would all be legal.

I carry one of my pistols up front with my in a soft side rug. I use one of those el-cheapo 3-digit combination locks to lock the zipper. Thing is, I can input two of the right numbers, then make the last digit one number off of the real one. Viola, almost instantaneous access to my weapon!

As for ammunition, well, I'm kind of stuck on that...

it's legal to have an unloaded shotgun in your car,and ammo on your belt.
being that a shotgun is "not readily concealable" it's legal to conceal
it under a blanket or duffle bag.

I live in the peoples republic of California.

It is not technically legal to transport a firearm in your car unless its for a CA legitimate reason. Carrying it to and from the gun range, gunsmith et cetera. Having it in your posession for self defense is not a legitmate reason according the CA law I beleive unless you have a permit to carry.
How many police are going to hassle you even when you're transporting it inside your car in a legal fashion? I don't know?

Most people don't understand how restrictive the state is. You cannot have any rounds in your pistol or even have a loaded magazine close to it. That may in itself be considered a loaded gun and is illegal even though you have a legitimate reason to carry it. Contrast this with driving over the border to Arizona where you can carry a loaded pistol in the car.

DO NOT, and I say again DO NOT put your gun in the glove box. California considers this a concealed weapon, and if something were to happen, and police end up finding it in your glove box you're in trouble. Someone I know purchased a Colt Python new in the box, he put it on the front seat, and just happened to get pulled over by the LAPD. They confiscated his gun because they considered it concealed being that the box wasn't locked.

If the pistol is in the driving compartment with you it needs to be in a locked container such as a breif case. If you put it in the trunk unloaded this will satisfy having it in a lockable container thats why the trunk is legal.



Penal Code 12001

(j) For purposes of Section 12023, a firearm shall be deemed to be "loaded" whenever both the firearm and the unexpended ammunition capable of being discharged from the firearm are in the immediate possession of the same person.

(a)Every person who carries a loaded firearm with the intent to commit a felony is guilty of armed criminal action.
(b) Armed criminal action is punishable by imprisonment in a county jail not exceeding one year, or in the state prison.

(1) Carries concealed within any vehicle which is under his or her control or direction any pistol, revolver, or other firearm capable of being concealed upon the person.

(3) Causes to be carried concealed within any vehicle in which he or she is an occupant any pistol, revolver, or other firearm capable of being concealed upon the person.
Penal Code 12026.1.

(a) Section 12025 shall not be construed to prohibit any citizen of the United States over the age of 18 years who resides or is temporarily within this state, and who is not within the excepted classes prescribed by Section 12021 or 12021.1 of this code or Section 8100 or 8103 of the Welfare and Institutions Code, from transporting or carrying any pistol, revolver, or other firearm capable of being concealed upon the person, provided that the following applies to the firearm:
(1) The firearm is within a motor vehicle and it is locked in the vehicle's trunk or in a locked container in the vehicle other than the utility or glove compartment.
(2) The firearm is carried by the person directly to or from any motor vehicle for any lawful purpose and, while carrying the firearm, the firearm is contained within a locked container.
Penal Code 12030

(l) Nothing in this section shall prevent any person from having a loaded weapon, if it is otherwise lawful, at his or her place of residence, including any temporary residence or campsite.
Penal Code 12031.

(a)(1) A person is guilty of carrying a loaded firearm when he or she carries a loaded firearm on his or her person or in a vehicle while in any public place or on any public street in an incorporated city or in any public place or on any public street in a prohibited area of unincorporated territory.
Penal Code 12034.

(a) It is a misdemeanor for a driver of any motor vehicle or the owner of any motor vehicle, whether or not the owner of the vehicle is occupying the vehicle, knowingly to permit any other person to carry into or bring into the vehicle a firearm in violation of Section 12031 of this code or Section 2006 of the Fish and Game Code.

SIGarmed you need to make a distinction between "firearm" and "concealable weapon". You can indeed carry a rifle or shotgun in your car all you want as long as it is unloaded. The laws you are talking about apply only to handguns and unless you are transporting your "concealable weapon" from that long list of places to your home, you must have it in a locked container other than your glove box. I highly recommend everyone read the law for yourself.

I think the shotgun or carbine idea would be your best bet if you really want to be armed. Just be prepared to be detained for a while until they figure out who you are. Not all cops are gun friendly and they might wonder why there is an out of stater carrying around a 12 gauge in his car with shells in his pockets. There is nothing by law they can do, but that doesn't mean they might not try.

As far as feeling sorry for me, I live in a free section of the PRK called Kern County. I have my CCW.

I have a gun in my car at all times and in the unlikely event that I'm asked, I'm on my way to a range. Usually, the gun is a revo in a gunrug with a luggage combo lock (one number to hit) within reach, box of ammo in the center console. If I'm going on a long road trip, to San Diego for example, I bring a printout (Yahoo yellow pages) of the addresses of local ranges at my destination.

CARRY YOUR WEAPON!

I am less than 2 years from Cali (Born and Raised) and used to carry most places especially in my car. Always concealed of course. Why? How? Because If I had ever been caught.........who cares?? For the otherwise law abiding citizen, it is not much more than a traffic ticket. Check the statutes, it is still a misdemenor. Even in California!
How could this still be you ask? Simple, because so many of the hypocrits in Sacto have friends and family who carry and they don't want them going to jail. Check it out for yourself. Over the years, there have been many attempts to turn it into a felony but it always gets killed.
 
I don't know what your talking about. I carry a Glock 27 for my CCW with a couple of 15 rounders for my spare mags. And I'm in Kali:neener: :neener: :neener:
 
Protection? I have a maglite I keep by my side and keep myself ready to move when I think I could be in danger. Someone could come up to my car with a knife or gun I suppose and if I have enough time to react with a weapon, I could just as easily hit the gas. If I have to I'll push cars out of the way to get away, I think the V8 in my mustang might be able to handle it. Sure it's damage, but I'm likely to keep the car and my life.

Doors are also always kept locked as well. Honestly though, I've never felt I was in danger in most places. There are those certain parts of town I won't go in, or at least I won't go in a little more alert than I normally would. I'd like to be able to carry in my car, but it just isn't that big of a deal for me.
