I was charged with misdemeanor gun charges in ohio.

    I was stopped and charged with improper transport misdemeanor 4. And concealed carry misdemeanor 1. The gun was confiscated and i went to jail. The police conveyed the charges as felonies as I was being arrested. The fire arm was unloaded and in plain sight. The ammo was locked under my seat i was in a mini van in ohio it states you have to leave the vehicle in order to access gun/ ammo combined. There was no storage space in the van not accessible from the inside. I had literally just purchased the gun and the ammo came with it . is there any way I'm getting that pistol back if I'm convicted.

    A lawyer would most likely be a better person to ask as opposed to a public Internet forum... Good luck.

    Was the gun in a seat or in the rear hatch-back? While the law states they must be stored separately and not accessible without leaving the vehicle, it also states that when no storage is available that is not accessible from the interior, it must be as far removed from any occupant of the vehicle as far as possible. IOW, if you had it in the passenger seat, you're screwed. If not, call a lawyer.

    Probably best for the OP to not answer this. He needs to not talk about it on a public forum and get a lawyer.

    The OP needs his own lawyer and not a bunch of anonymous denizens of cyberspace. Among other things what you talk about with your lawyer is private, but everything here is public.
