Missoula County deputy accused of playing hooky from trial date

A Missoula County deputy faces a contempt of court charge for claiming he needed to skip a trial appearance because of a family emergency, when instead he was apparently selling items at last weekend's gun show.

According to court documents, Deputy Richard Eggett was supposed to testify in an Aug. 6 nonjury trial before Justice of the Peace Karen Orzech involving two traffic tickets. County Attorney's Office legal intern Kent Leier was handling the case, and he requested a delay Aug. 3. In his request, Leier wrote that "State's Witness, Dep. Rich Eggett, is unable to appear on Aug. 6, 2004, because he must go out of town due to a sudden and unexpected family emergency."

"We subsequently learned his (Eggett's) reasons weren't valid," Missoula County Attorney Fred Van Valkenburg said Friday. "He was an exhibitor at the gun show."
