I don't agree with warning shots much, either. However, I suspect that a large number of reported "warning shots" actually weren't, but were instead shots that missed, and were reported as warning shots because the persons firing them figured they'd be better off legally if they didn't admit to having just tried to shoot another human being. There are a lot of people who have acted within legally-acceptable limits, but still fear prosecution (and persecution.)
