In response to the COVID-19 pandemic, Governor Ralph Northam’s recently issued Executive Order 53 temporarily places restrictions on numerous businesses across the state. Though it does not designate firearm and ammunition retailers as “essential retail businesses,” they “may continue to operate but must limit all in-person shopping to no more than 10 patrons per establishment… with proper social distancing requirements.”

Worse, some jurisdictions that have criminalized the private transfer of firearms have also shut down access to guns stores or their state criminal background check system. This lethal combination of misguided policies has made it impossible for millions of Americans to acquire, or even borrow or lend, firearms during this moment of crisis.

Gun Control Advocate Assures Americans: There’s No Need to Buy Guns ‘Cause “the Zombies” Aren’t Coming
The FBI performed a record-breaking 3.7 million firearm-related background checks last month. According to an April news release from Small Arms Analytics & Forecasting (SAAF), March 2020 estimates of firearm sales show an increase of over 85% from March 2019 – single handgun sales jumped by 91%, and single long-gun sales increased by over 73%.

Pandemic Exposes Dangers of Severe Gun Controls in Connecticut and D.C.
Gun owner licensing and registration, "universal" background checks, and restrictions on the sale of ammunition. Gun owners have been told again and again that these are sensible measures that empower the government to ensure that firearms don't end up in the wrong hands. However, the COVID-19 pandemic has made clear that when governments are incapable or unwilling to perform the gun control measures for which they have been tasked, law-abiding citizens end up being denied their Second Amendment rights in total.

The Betray State: Massachusetts's Anti-gun Politicians Use Pandemic to Trample Rights
In recent years, the Bay State's two highest-ranking public officials have been at war with the Second Amendment. In 2016, Attorney General Maura Healey (D) unilaterally perverted a state law that had been on the books for 18 years in order to prohibit thousands of legal semi-automatic firearms. In 2018, Governor Charlie Baker (R) undermined the government's system of checks and balances to attack gun owners when he refused to reinstate some Massachusetts residents' Firearm Owner Identification (FID) Cards after the Firearm Licensing Review Board had restored their gun rights and a judge had issued a lawful court order directing the state to grant the FID card. Baker finally backed off this position in early 2019, but only for those who obtained a court order directing the state to issue them an FID card.

U.S. Senators Use COVID-19 to Push Longtime Gun Control Agenda
The COVID-19 panic has been used by would-be state and local authoritarians as an excuse to keep Americans from exercising their right to keep and bear arms. Thankfully, American gun owners have a friend in the White House that has worked to protect their rights on the federal level by declaring the firearms industry to be critical infrastructure. However, this respect for the Second Amendment isn't uniform in the federal government. There are some federal lawmakers seeking to exploit COVID-19 to pursue their pre-existing gun control agenda.

Citing COVID-19, California Extends Ex Parte "Red Flag" Gun Confiscation Orders to 110 Days!
A state with one of the worst "Red Flag" gun confiscation laws on the books just got worse. On April 13, California Attorney General Xavier Becerra issued a guidance document on the procedures concerning certain types of restraining orders. Citing the ongoing COVID-19 panic, Becerra noted that all ex parte Gun Violence Restraining Orders (EGVROs) are to be extended 90 days past the statutory expiration date. Under state law, such orders expire after 21 days - meaning that an ex parte GVRO may now last up to 110 days. California's latest attack on gun rights and due process should serve as a warning to gun owners across the country about the dangers inherent to "Red Flag" gun confiscation laws.

Virginia Anti-gun Activist Unveils 2021 Gun Control Agenda
On April 10, disgraced Virginia Governor Ralph Northam signed five pieces of anti-gun legislation into law. Those measures criminalize the private sale of firearms, ration handgun sales to one a month, create a "red flag" gun confiscation scheme, punish property crime victims who fail to hastily report a firearm as stolen, and restrict how Virginia parents may store and introduce their children to firearms. Northam sent two pieces of anti-gun legislation back, including legislation that erodes the Right-to-Carry and the state firearms preemption statute, to the general assembly with governor's amendments. The General Assembly enacted both items of legislation on April 22.

U.S. Olympian: 1, Gun Controllers: 0 – Judge Blocks Unconstitutional California Ammunition Laws
Kim Rhode is one of America’s most decorated Olympians, having medaled in six consecutive summer games. California, however, passed ammunition purchase laws that effectively blocked the El Monte resident – as well as police officers and other Californians who wanted ammunition for lawful purposes – from obtaining the supplies she needed to maintain peak proficiency. With the backing of the National Rifle Association and its California state affiliate, Ms. Rhode and other Golden State residents sued, claiming the laws violated their Second Amendment rights.

Lawsuit Filed Against Jackson Mayor’s Illegal Open Carry Gun Ban

The Mississippi Justice Institute, a non-profit constitutional litigation center, has filed a lawsuit on behalf of pro-Second Amendment State Rep. Dana Criswell (R-Mount Olive) against Jackson Mayor Chokwe Antar Lumumba's executive order prohibiting the open carry of firearms in the city.

Despite ongoing speculation as to whether a deteriorating Joe Biden will even be the Democratic Party's 2020 presidential nominee, on April 28 failed 2016 Democratic presidential nominee Hillary Clinton endorsed the former vice president's White House bid. NRA's effort to vindicate the Second Amendment rights of young adults in Florida in the case NRA v. Swearingen has passed an important milestone. On Friday May 1, the Chief U.S. District Judge for the Northern District of Florida Mark E. Walker denied almost all of the state's motion to dismiss, allowing the case to move forward. Citing the relevant caselaw, Walker noted that NRA's complaint "contains 'enough facts to state a claim to relief that is plausible on its face."

Despite Confiscation, New Zealand Sees Most Gun Crime in a Decade

Not Funny: Firearm Prohibitionists Finally Target Elmer Fudd’s Gun
For some in the pro-gun community, the term “Fudd” denotes a person who owns guns, typically not for self-defense, but considers themselves above the fray of Second Amendment politics. But it is not owning this or that type of gun that makes a person a Fudd. Rather, it’s an attitude of indifference to the besieged plight of gun owners generally. The name derives from Elmer Fudd, the classic Looney Tunes/Merrie Melodies cartoon character who single-mindedly pursued ducks and rabbits (Daffy and Bugs in particular) with his trusty assortment of long arms, usually to his own detriment.

Supreme Court’s Inaction Frustrates Second Amendment Supporters, Emboldens Anti-gun Activists
Gun owners are by now used to being disappointed with the U.S. Supreme Court’s refusal to uphold their rights or even to defend its own Second Amendment precedents. But the court’s neglect reached a new low last Monday, with its sweeping decision to deny review of the many Second Amendment cases pending on its docket.

Legal Reckoning for Jackson, MS Mayor’s Foolish Carry Ban
As we reported earlier, Chokwe Lumumba, the mayor of Jackson, Mississippi, announced an executive order on April 24 as part of his response to the COVID-19 civil emergency. The order prohibited the “carrying of an unconcealed loaded or unloaded pistol or revolver or any other firearm, carried upon the person or in a sheath, belt holster or shoulder holster or in a purse, handbag, satchel, other similar bag or briefcase or fully enclosed case, with such pistol, revolver, or firearm being wholly or partially visible.”

Florida Court Recognizes Popularity of Carry Permits, Rules Police Cannot Use Possession of a Gun as Sole Basis for Investigatory Stops
An appellate court in Florida recently decided that a police officer who sees a firearm when approaching a citizen is not permitted to rely exclusively on the possession of the firearm as the justification for an investigatory stop and search. Bearing arms is not only a lawful activity, it is “a specifically enumerated right” protected under both the state and federal constitutions. Taking into consideration the sheer number of persons in the state who are permitted to carry concealed weapons, this “potentially lawful activity cannot be the sole basis for a detention. If this were allowed, the Fourth Amendment would be eviscerated.”

Trump Hits Judicial Milestone
This week, President Donald Trump’s 200th judicial nominee was confirmed; Judge Cory Wilson of Mississippi. Wilson will join the U.S. Court of Appeals for the Fifth Circuit. Trump has now filled all federal circuit court vacancies, and appointed more appellate judges than any other president at this point in his presidency. He is closing in on making as many circuit court appointments as President Obama made throughout his two terms in the White House.

Maryland Illustrates Problem with Requiring Permission to Exercise Constitutional Rights
2020 continues to serve up examples of why Americans should not tolerate gun control schemes that require citizens to obtain government permission before exercising their Second Amendment rights. This week, the Maryland State Police experienced what they termed a “catastrophic hardware failure” that interrupted that state’s ability to process regulated firearm purchase applications. The failure complicated Marylanders’ ability to access handguns at a time when many residents are seeking to protect themselves.

Virginia: Anti-Gun Laws Take Effect Tomorrow, July 1

Tomorrow, July 1st, the anti-gun bills passed by the General Assembly and signed into law by Governor Ralph Northam will take effect. Though Gov. Northam was unable to get the General Assembly to pass his comprehensive gun ban during the 2020 session, he stated during his press conference at the bill signings that he will seek it again next year.

Colorado Supreme Court Upholds 2013 Magazine Ban
In 2013, Colorado enacted House Bill 13-1224, which made it a crime, with some exceptions, to sell, transfer, or possess any “large-capacity magazine”after July 1, 2013. A “large-capacity magazine”meant any “fixed or detachable magazine, box, drum, feed strip, or similar device capable of accepting, or that is designed to be readily converted to accept, more than fifteen rounds of ammunition.”

North Carolina: Second Amendment Preservation Act Up for Veto Override Tomorrow

Tomorrow, the House of Representatives will consider overriding Governor Roy Cooper’s veto of the Second Amendment Preservation Act. Gov. Cooper erroneously claimed that the bill will allow guns in schools and threatens the safety of students and teachers. Instead, it only applies to churches that operate schools and simply allows parishioners to carry when the schools are not in session, if the church wishes to opt-in.

North Carolina: Gov. Cooper Vetoes Bipartisan Second Amendment Preservation Act

On July 2nd, Governor Roy Cooper vetoed House Bill 652, the Second Amendment Preservation Act, despite it passing the General Assembly with bipartisan supermajorities. He erroneously claimed that the bill will allow guns in schools and threatens the safety of students and teachers. Instead, it only applies to churches that operate schools and simply allows parishioners to carry when the schools are not in session, if the church wishes to opt-in Gov. Cooper’s veto shows that he cares little about personal safety or private property rights. HB 652 will now go back to the General Assembly, where they may consider a veto override.

Lori Lightfoot Either Doesn’t Understand Federal Law, or Hopes Nobody Else Does
It has become commonly accepted among anti-gun extremists to ignore the mountains of evidence that exposes the abject failure of gun control to prevent violent criminals from acting like violent criminals. They reject the fact that criminals already violate myriad laws at the local, state, and federal level in furtherance of their illicit activities, and insist that the only way to prevent criminals from committing crimes with firearms is to add more laws.

Trump Administration Fixes Suppressor Export Rule
Effective immediately, the Department of State has rescinded its April 18, 2002, firearms sound suppressor policy. This policy provided for enhanced guidelines for the approval and issuance of export licenses for sound suppressors and restricted their export to only official end users such as government or military entities. Henceforth, DDTC will handle suppressor exports in a manner consistent with other USML-controlled technologies. This requires that applicants must identify a specific end user. Applications for the permanent export of hardware must include purchase documentation, a DSP-83 non-transfer and end use certificate (as suppressors are considered Significant Military Equipment under the USML), an end-user statement, and an import permit (if required by the destination country). Consistent with current licensing practices, all licenses will be reviewed and adjudicated on a case-by-case basis, and any pre-license checks or post shipment verifications will be conducted as deemed necessary and appropriate based on the totality of the circumstances of the transaction. Standard staffing protocols within the Department and interagency will be applied as required.
