I'm not a lawyer and don't have any insight into the legal standing of their claim (I would be very interested if any of our resident lawyers could speak to that). However, I highly doubt that the US would allow one of their own citizens to be extradited to a foreign country while the US gov is in the process of trying them for murder.

Hopefully, a TX jury will find him guilty, appeals will go through fast and less than 13 years, TX executes him. Then they can send the body to MX for trial. (I believe it took 13 years, after a guilty verdict for TX to get around to executing Lawrence Russell Brewer for murdering and dragging a man behind a vehicle.)
