I live in the gun friendly state of Indiana, and my best buddy lives in the not so friendly Michigan. I have stumbled across a Tokarev at a great price that I would like to give to him as a gift for agreeing to be the godfather of my daughter. It's an old Norinco 213 9mm that comes with a hard case for transport/storage. It was imported legally as it has the wonky manual safety.

He wants to stay legal, of course, but reading up on the MI laws is a little confusing. Basically, he would like to know exactly what he would need to do in order to transport the gun from IN, through Ohio by car, and keep it legal in MI. He isn't interesting in carrying the pistol for self defense, but he would like to be able to transport it to and from the gun range for target practice.

Could any of you guys be so kind as to give us the basic idea of what he needs to do in order to be Kosher in the eyes of the MI law? I'm just going to give it to him, but does he need a bill of sale or something? He lives in Plymouth (basically right outside of Detroit) if that helps at all.

Since you are in two different states, you will need to send the gun to his FFL in Michigan who will do the transfer there. You can't just hand it over like a box of chocolates.

Let me ask you this as well, if you don't mind. His dad has several handguns that belonged to his grandfather that he would like to pass on to him. How does MI handle heirlooms. Also, what would one do if they had pistols in their possession from out of state and then moved into MI? Say I were to move there with my half a dozen pistols. What would I need to do?

Thanks guys, I got it. Looks like I'd have to register mine with the law enforcement should I move up there. Doesn't sound too bad...i mean, not great, but not too bad.

I don't know if MI has specific laws on inheritance of firearms but the Federal laws do cover it.

If his Dad wants to pass them along most easily, he can simply put them in his will with instructions that they are bequeathed to his son. In that case no 4473 transfer has to take place, even if the son lives in another state.

If they want to do things a little sooner than that, then the "passing on" is a transfer just like a sale, and they'll have to handle it just like any other handgun transfer in MI. It appears the son will need a pistol purchase permit but that the transfer can happen "face-to-face" between him and his dad without going through an FFL.

You said he does not want to carry the Tokarev, but you did not specify whether he has his CCW/CPL. If he does, that serves as an automatic permit to purchase.
