GRAND PRAIRIE -- Police said they plan to file capital murder charges against a Grand Prairie man who claimed he shot two robbers in self-defense.
Foyil Edward Deal, 63, is being held in the Dallas County Jail in lieu of $750,000 bail, police said.
"Information came to light during the investigation that led to a serious question of whether deadly force was necessary," said police spokesman Detective John Brimmer. Police will refer the case to a Dallas County grand jury.
Police were called to Deal's west Grand Prairie home Tuesday morning where they found the bodies of Wylie Casey, 35, of Arlington, and Wesley Duncan, 40, of Cleburne, inside a car parked in the driveway. Police said the driver was wearing a ski mask.
Deal told police that he was being robbed by the men and decided to shoot them after one man had threatened him with a baseball bat. Deal said the men forced their way into his house about 8:30 a.m., drove him to an automated teller machine, made him withdraw cash and then drove him back to his house.
Police said they believe that from statements made by Deal, deadly force may have been in excess of the danger he was in. Investigators declined to discuss what information surfaced in the investigation that led them to question Deal's actions.
