The Army reservist who was jailed for holding seven illegal aliens at gunpoint until Maricopa County, Arizona, sheriff's deputies arrived will not be prosecuted as the action was determined to be a legal citizen's arrest.

County Attorney Andrew Thomas announced his decision today that Sgt. Patrick Haab did not commit a crime. He has been charged with seven counts of aggravated assault.

"This is a unique case with a very unique set of circumstances, and after a full analysis of the issues involved and the applicable law, prosecution is not appropriate," said Thomas.

Haab said he was acting in self-defense.
 
Good for him! I was pretty sure it would go the other way but I was hoping he would not be charged. I would be willing to bet that next time he uses a cell phone instead of a gun to take care of that situation.
 
I don't think many folks who live here were suprised ...

County Attorney is an elective office ...

And this is Arizona.

he's a reservist? well i feel like a retard, that changes everything. someone trained by military, he sees this crime, yeah, i support him fully.
i had previoulsy not been so sure.

i dont want everyone with a gun hunting aliens. i said it before, think of the "gagnsta at the range" thread.

BUT= this guy, sure, there should be a free class to get certified for this type of thing, defaulted to LE/military

Careful with that sort of thinking. There are many, many military specialties that don't prepare one for that sort of activity in the least. Remember, the military is primarily trained and equipped to blow stuff up and kill people.

Our president said these folks are vigilantes. I think it's embarassing to the powers that be that ordinary citizens are actually catching illegal aliens when the govt. run agencies are failing.
 
Hmm...so what was all that wailing and gnashing of teeth we were hearing here, about how people just can't do this and how if anyone tries it it's a guaranteed trip to jail, and you can't harrass Illegals, and...

Well, imagine that. Thoughtful deliberation on a single topic and the weighing of its merits, etc., etc. Just goes to show that zero tolerance for actions is a crock and that analyzing each action in and of itself is the path best taken.

I have been wondering if the Reservist has a good case for False Arrest.

Since they arrested him, he spent time in jail, may have ruined his military career, he had to post post $10,000 bail and then they investigated.

We had a case here where a man was arrested, his name was given to the press, and then they investgated and said there was no case. He walked off with $100,000 from the PD. :evil:
 
Considering the static over the initial event and how dire the consequences would be for the fellow this is certainly a mighty quiet thread...
 
Part of his salvation came from several conservative talk radio hosts picking up the story and making noise. What was learned by the public through them is that the illegals came out of the bushes in a manner that was described as "rushing" him. This set up a reasonable fear on his part which justified all that followedl

I wonder how the mainstream media missed that, yet is was readily available to Sean Hannity and his ilk?

i did not put that in red, he did, to insult me, and further , only a someone desrving such a sterotype would make a location based statement like that-

or am i insulting rednecks here? if so, sorry for that, i forget some are proud of that term. kinda like hippy , it goes either way.

The talk shows put the story in public view. I heard this fellow in Hannity. I couldn't help but think this young man was being rail-roaded. Me thinks the arresting agency was becoming uncomfortable with the negative PR and cut the guy loose on what was a weak case.

I tip my hat to the radio guys on this one. I wonder if it hadn't been for talk radio if the local LE wouldn' have happily scr-wed this guy over and never looked back.

I don't know about the national media, but the story got substantial play in the local (Arizona) press. Obviously the Sheriff made a wrong call on this one, or at least a VERY unpopular one. If the case had gone forward I think it would have been very difficult to find a jury that would convict. It would have only taken one member to hang it, and it's likely there would have been more then one.

At the field agent level the Border Patrol is doing a fine job. The trouble is that the folks in Washington will not give then the financial and other resources to do the job effectively. There is too much border, in very rough country, and far too few people to patrol it. That, and as soon as those that are caught and released back into Mexico, they come right back. As a practical matter you cannot expect a few hundred Border Patrolmen to stop an influx of people that numbers in the hundreds of thousands.
