What do folks here think will happen to the clerk?

Taking away BG's gun, no problem. But after taking the gun, was the clerk still in imminent danger of death or serious injury, sufficient to warrent shooting BG?

A teen who attempted to rob a Texas fireworks stand Thursday ended up getting shot in the face with his own gun by one of the business’ employees, police said.

The attempted robbery occurred in Harris County at around 4 p.m. when the 19-year-old suspect approached the stand and demanded money, the Harris County Sheriff’s Office said.

An employee got the money and put it on the counter, according to ABC 13, and deputies said when the suspect placed the gun down to pick up the money, the employee picked up the firearm and shot the suspect in the face.

The teen, who wasn’t immediately identified, was taken to the hospital in critical condition.

It wasn’t clear whether the person was expected to survive.
 
Harris county is Houston. Big city, is it liberal enough to prosecute?

Well, 19 is a teen number but that age is a legal adult for most purposes, he can drive, vote, join the Army, get married, sign a contract, buy fireworks, buy a shotgun (but not a pistol or beer.) And get shot for a stupid holdup.
Are our media objective about such stuff? Or will we see pictures of him in the ninth grade?
 
It will all depend on how fast it went down, and how unstable the situation
could "reasonably" be viewed to be in the very few seconds of threat reversal.
 
Here’s what will be the decider on whether there’s prosecution in the victim’s future... It will depend mostly on the race of the shooter and the shootee...

I’ve actually seen this play out in real life during my 22 years in police work... on more than one occasion.

Wish it weren’t so since that one factor should not come into play at all. Justice should be color blind - and every shooting victim’s family should expect and receive a fair and impartial process without exception.

As my Dad used to tell me “kid I know more about that than I ever wanted to know”.
 
Unfortunately ST&T isn't the place to discuss how race figures into prosecutions. I'm going to close this thread until more information about the actual circumstances of the shoot become available. Anyone who gets more information is free to contact me and will reopen the thread.

How the race of the shooter and robber figures into prosecution is a subject that should be discussed, but I really don't know any sub forum on THR where we could have that discussion and keep it within the rules. It's an emotional subject that will likely end badly on a public forum.
