Hey guys,
Had a caffeine induced though this morning. Does any state have any laws freeing retail establishments from civil liability from any actions (in defense or incompetence) from lawful gun owners carrying in their establishment? Seems to me this would take a major anti tool away from them.

The way I see it, if I screw up with my gun, it is MY responsibility and liability should begin and end with me not the store I happen to be standing in.

I imagine if you tied something like that, extending the freedom from civil liability for all retail establishments to a restaurant carry bill, you would find a lot of restaurants and retail establishments actually being in favor of the bill.

Ohio.

(2)(a) A private employer shall be immune from liability in a civil action for any injury, death, or loss to person or property that allegedly was caused by or related to a licensee bringing a handgun onto the premises or property of the private employer, including motor vehicles owned by the private employer, unless the private employer acted with malicious purpose. A private employer is immune from liability in a civil action for any injury, death, or loss to person or property that allegedly was caused by or related to the private employer’s decision to permit a licensee to bring, or prohibit a licensee from bringing, a handgun onto the premises or property of the private employer. As used in this division, “private employer” includes a private college, university, or other institution of higher education.

Conversely, does any state have a law that requires an establishment prohibiting lawful carry of any type be responsible for the safety of the patrons? In other words, if they say I can't carry and someone opens fire in the business, are they then responsible for medical/funeral expenses (among other things)?

I would suspect some lawyer would come up with a way to do this. They are pretty much announcing to BG's that law abiding citizens are not carrying there. Making themselves a soft target without any additional security of their own to counter that. I would definitely think a lawsuit would find a way of winning.
