SC Senate passes Gun Ban for Domestic Violence Offenders

The bill aims to make domestic violence penalties stronger, it passed the Senate 38-3 and it still has to pass the House which is also considering a different version of the bill.

What is the point of this law if the Lautenberg Amendment already covers Domestic Violence? Is this a 'preemptive step' in case Lautenberg gets overturned someday? Wouldn't this law be considered redundant?

"COLUMBIA, S.C. (AP) -- In a state where gun rights tend to be fiercely guarded, the South Carolina Senate on Wednesday agreed to take firearms away from many people convicted of criminal domestic violence. The gun ban would still require a judge's approval for the least serious offenses. A provision adding that requirement cleared the way for passage of the bill to strengthen domestic violence penalties across the board. The measure passed 38-3 after nearly two weeks of debate."

Will razor blades, knives and scissors also be taken away? Or just those evil weapons that get up on their hind legs and go bang?

And this state ,which supposedly so fiercely guards its gun rights, is one of only 6 states which does not allow Open Carry, one of only 9 where you have to notify the LEO you are carrying on official contact, and one of only 4 where you have to notify the homeowner you are carrying before entering his or her domicile.

This is fiercely guarded gun rights? :what: Total bull.

Feel good laws - except when you peel back the definition of "domestic violence."

I know of "domestic violence" convictions that was literally a loud argument, and trivial property damage such as breaking a dish, punching a wall, throwing a towel the other person, tossing someones stuff out on the porch, or a mean look.

And this law really does nothing to curb violence. Like everything, real criminals bent on violence and murder (illegal already) will ignore the law against having a gun. Or they will simply use a different weapon like a bat, knife, car, scissors, fire, rope, duct tape, stun gun, etc. etc. etc.

This anti-gun nonsense must stop. We have laws against real assault and that should be adequate.

Want to address domestic violence? Start with teaching kids respect for others, improving K-12 education, and improving MATE CHOICE in teens, reduce teen pregnancy, increase employment numbers for teens, etc.

Yep!

But...........what you're stating is something called common sense, and it too has been outlawed for a while now.

I agree with that part - private property rights trump yours. MY house, MY rules. If for whatever reason I want no guns, you know that and you violate that, what does that say about you and your integrity. Remember, integrity is doing the right thing even when nobody is watching.......

I really wish we could get some roads repaired around here.

While we're at it... Closed primaries and term limits would go a long way.

Tell that to the 46 other states that don't agree with your quixotic noble gasping's of having to get down on bended knee and asking permission.

Am I loosing it or has there not been a Federal Law that prohibits any one who has EVER been convicted of any kind of misdemeanor domestic violence from ever owning a firearm? Always thought it sucked because it was retroactive and I thought that was unconstitutional. Called an ex post facto law as I recall from high school social studies.

You do not have to kneel...........but it IS polite to ask and see if the owner has an issue - whether you think it is or not.......Their house their rules, don't like them, don't go in.

The law and order crowd is after Rights just as hard as any other anti Constitution/Freedom gang. Probably worst. The disastrous war on drugs being notable.

All kinds of off-topic. This could have been a worthwhile discussion of a serious legal issue.

Unfortunately, folks wanted to bring in property rights and road repair and such. And I'm not interested in spending the time to clean this up and keep it on track.
