Suppressor wait time extended?

Quick question from a first time suppressor buyer...

My dealer says I have to wait (going on 90 days here) for the manufacturer to transfer the unit to them before they can even start my paperwork. This is not a unique can (Silencerco - Octane 9 HD) but they had to order it as it's not something they usually stock. Is this a normal stepping stone in the process? I assumed the manufacturer would be able to provide the serial number right away in order for me to submit the paperwork for my tax stamp. Has anyone had the same experience?
 
I emailed a rather large supplier of Silencers. I wanted specific consecutive numbered silencers. They didn't have the numbers I wanted, but had consecutive numbers. I called them to pay with my card and to verify the numbers. They charged my card and emailed a receipt with the numbers we discussed. When the silencers arrived (Form 3) to my dealer they were not the numbers I ordered/paid for.

Had my dealer used the numbers on my receipt, my Form 4 would have been wrong.

Some dealers will make you wait till the silencer is in their hand, others don't.
 
Get a different dealer. Some dealers want you to wait for a form 3 to clear before they start a form 4 . It is recommended by the ATF to do it that way because it keeps the paperwork straight in case a form 4 is approved before a form 3 or because of confusion of the numbers etci. That is just a recommendation, not a law, and its because of something that "almost" never happens. Many dealer dont bother and file a form 3 and form 4 at the same time. My dealer does that. One thing Ive learned over the years is that you won't talk a dealer who does something their way to do it your way. Get a different dealer who does things the way you want.

You don't start any paperwork.
The manufacturer will file a Form 3, and when approved will ship the silencer to your dealer.
Your dealer then completes a Form 4. While some dealers will file a Form 4 before actually having the can in hand..........it's risky:
1. The dealer would be falsely filing the Form 4. You can only file a Form 4 for NFA firearms in your possession.
2. If your Form 4 comes up before the Form 3 is approved.......they'll deny it.

I think you're spot on with everything except the last comment. I think it's pretty normal for people to mail in their own (as transferree) form 4s. Particularly individuals that need CLEO sign off.

Thank you all for your replies- I will give them call and see what there normal process is for forms 3&4 and try to get some clarification. I'll keep you updated on their response.
 
No doubt they are waiting for the form 3 to clear. Some dealers do that , there is good reason to and some could care less.

Ive had it happen where the form 4 cleared before the form 3 . A few phone calls and a ATF examiner who really didnt care and it was all taken care of. Fastest form 4 I've ever had at 6 weeks. No one saw that coming.

If you have a dealer and original distributor who will play ball its not a big deal. If not everyone wants to play you wait.
 
They have to have the Serial number of the unit before the forms can be submitted. Most dealers will submit the forms if the manufacturer/seller of the suppressor will just give them the serial number. Some are to anal even do that before the hardware is in their hands.

Like most things in the USA today, everything is in short supply and understaffed. So, it could be a long wait if you have to wait for it to be manufactured.

My first suppressor took over 9 months to get, the second just over 4. I bought another for my Sig MPX last week. We will see.

It's not being "anal", it's following ATF instructions.
If ATF wanted to, they could revoke a dealers SOT for falsely filing a Form 4 before the firearm is in the dealers possession. At my compliance inspection two weeks ago this was part of my review....DON'T FILE FORMS ON FIRERAMS YOU DO NOT POSSESS. That said, Silencer Shop does it this way hundreds of times a week.
