Right now I am not sure if the bill by Gianaris (NY) that will require muzzleloaders to be licensed and restricted as any other gun is still in effect right now.

The only information I can find about this bill is right here:

Can somebody please interpret the above for me, since right now, the bill has no votes and I am not sure if it already passed through or is just lying dormant like the HIV virus, waiting for the right moment to flare up into full blown AIDS.

I am planning a ten page letter to Gianaris and other state legislators, reminding them to go after the REAL menaces in NYS, such as all the robberies and assaults every day, and stop targeting the owners of muzzleloaders.

This bill must be STOPPED IN IT'S TRACKS!! If this becomes law, it will have catastrophic consequences for the rest of the country. If this bill becomes law, it will mean that the left wing socialists have yet infringed on our rights by another step, like a noose that is tightened around our necks gradually.

This bill is a pure example of tyranny and I need everybody's help to defeat it.

It's my first time doing this, but how do I go about starting a petition in NYC?

I want to have all muzzleloader owners , gun owners, and NRA members in the entire city on this petition so I can send it to the Assembly along with my letter. This is going to be the biggest project I ever undertook so far. All help is appreciated.

Yes, also, SS Firearms in Glendale is good to start with too.

I don't live far from them. They are on Myrtle Avenue, right by the J and M Train stations, I think.

I can start the petition over there, hopefully, the folks over there can send it out to all their customers and supporters, and then this petition can head on to the regional NSSA or American revolution groups.

This bill is a precursor to full and undiluted tyranny. Some people may not know it, but it is not about getting muzzleloaders out of the hands of felons, it is a ploy to COMPLETELY disarm every single citizen who loves and respects his/her Flag and country. WE MUST NOT LISTEN TO THE SIRENS' SONG.

4v50, do you have an idea what the bill on the link means? I have trouble finding it out. It seems like the bill is stalled around February, and there are no votes on it either.

THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1. The general business law is amended by adding a new section
390-d to read as follows:

S 390-D. SALE OF ANTIQUE WEAPONS.

NOTWITHSTANDING ANY OTHER PROVISION OF LAW TO THE CONTRARY, EVERY RETAIL SALE BY A FIREARMS DEALER IN THIS STATE OF A MUZZLE LOADING WEAPON HAVING A MATCHLOCK, FLINT-LOCK, PERCUSSION CAP OR SIMILAR TYPE OF IGNITION SYSTEM, OR A WEAPON WHICH USES FIXED CARTRIDGES WHICH ARE NO LONGER AVAILABLE IN ORDINARY CHANNELS OF COMMERCIAL TRADE SHALL BE SUBJECT TO THE SAME FEDERAL, STATE AND LOCAL REQUIREMENTS AS THE RETAIL SALE OF A RIFLE, AS DEFINED IN 18 U.S.C. 921(A)(7), IS SUBJECT TO.

2. THE PROVISIONS OF SUBDIVISION ONE OF THIS SECTION SHALL NOT APPLY TO ANY RETAIL SALE TO: (A) A MUSEUM OR HISTORICAL SOCIETY THAT IS INCORPORATED FOR THE PROMOTION OF ART, EDUCATION, HISTORY OR SCIENCE OR TO ANY PERSON ACTING ON BEHALF OF SUCH A MUSEUM OR HISTORICAL SOCIETY; (B) A HISTORIC SITE OR TO ANY PERSON ACTING ON BEHALF OF A HISTORIC SITE; (C) AN ACTIVE MEMBER OF A BONA FIDE GROUP OR ASSOCIATION ENGAGED IN THE REENACTMENT OF HISTORIC EVENTS OR MILITARY BATTLES OR CONFLICTS; OR (D) AN ACTIVE MEMBER OF A BONA FIDE GROUP OR ASSOCIATION ENGAGED IN CONDUCTING LIVING HISTORY EVENTS, EDUCATIONAL EVENTS OR INTERPRETIVE EVENTS.

WHENEVER THE ATTORNEY GENERAL SHALL BELIEVE FROM EVIDENCE SATISFACTORY TO HIM OR HER THAT A PERSON HAS VIOLATED ANY OF THE PROVISIONS OF THIS SECTION, THE ATTORNEY GENERAL MAY BRING AN ACTION OR SPECIAL PROCEEDING IN THE SUPREME COURT FOR A JUDGMENT ENJOINING THE CONTINUANCE OF SUCH VIOLATION AND FOR A CIVIL PENALTY IN AN AMOUNT NOT TO EXCEED TEN THOUSAND DOLLARS. IF IT SHALL APPEAR TO THE SATISFACTION OF THE COURT OR JUSTICE THAT THE DEFENDANT HAS VIOLATED ANY PROVISIONS OF THIS SECTION, NO PROOF SHALL BE REQUIRED THAT ANY PERSON HAS BEEN INJURED THEREBY NOR THAT THE DEFENDANT INTENTIONALLY VIOLATED SUCH PROVISION. IN SUCH ACTION PRELIMINARY RELIEF MAY BE GRANTED UNDER ARTICLE SIXTY-THREE OF THE CIVIL PRACTICE LAW AND RULES. IN CONNECTION WITH ANY SUCH PROPOSED APPLICATION, THE ATTORNEY GENERAL IS AUTHORIZED TO TAKE PROOF, ISSUE SUBPOENAS AND ADMINISTER OATHS IN THE MANNER PROVIDED IN THE CIVIL PRACTICE LAW AND RULES.

S 2. Subdivision 5 of section 895 of the general business law, as
added by chapter 189 of the laws of 2000, is amended to read as follows:
"Rifle" has the same meaning as that term is defined in 18 U.S.C. 921(a)(7), AND SHALL ALSO INCLUDE ANY MUZZLE LOADING WEAPON HAVING A MATCHLOCK, FLINTLOCK, PERCUSSION CAP OR SIMILAR TYPE OF IGNITION SYSTEM, OR A WEAPON WHICH USES FIXED CARTRIDGES WHICH ARE NO LONGER AVAILABLE IN ORDINARY CHANNELS OF COMMERCIAL TRADE.

S 3. This act shall take effect on the first of January next succeeding the date on which it shall have become a law.

Rachen - it means that the sale of muzzle loaders both old and new shall be regulated as modern cartridge guns unless the sale is to a museum, historical society or member of a bona-fide reenactment group. It also imposes "strict" liability for those who violate this law. Strict liability does not require a "mens rea" (knowledge that one is doing wrong) for a penalty. One need only commit the "actus rea" (the act itself) to be guilty.

As it is, presently the bill is in assembly. It's not to late to raise the hue and cry and get this dangerous piece of legislation struck down.

Yep, definitely un-American and absolutely infringing.

Actually I was having a hard time interpreting the bill's stats itself, not the wording. I am not sure if the bill has either been stalled, already passed, canceled, or void. There was no votes, yet. Do you know, based on the limited information that pages gives us, the progress of this bill?

Tomorrow, my petition will be sent to SS Firearms, while letter will be worked on. Also more letters are to follow, to the guys at NSSA and American Revolution to urge them to sign the petition and join in the efforts once my petition reached them.

I will continuously update you guys and gals on the progress of this project.

This bill just cannot be passed...it is a portal to the destruction of what America stands for.

I don't think that it would pass muster on court appeals since it grants rights to a certain class of individuals based on their membership in a "bona fide" re-enactment group.
How does membership in a private group qualify a person for special rights?
I guess that there would need to be some new private re-enactment groups created with easy & immediate registration requirements.
Something like the "Sons of Liberty Bronx Bombers Re-enactors" or the "Tea for 2 Dumping Party - Let's Go METS Vets!"? :neener:

Oh man that is funny as hell right there! Bronx Bombers, Mets, LOL.

I am starting an online petition. National scale. No more limited to NY state only. NY assembly has to hear the REAL VOICE, not the biased anti gun media. I will notify everyone once it is started.
