US Senator From PA No Friend of Second Amendment

While Sen Toomey may have had the backing of the Tea Party in the last election, it is far from a slam dunk that he is a gun backer. I have sent him three letters, none of which have been answered. I called the NRA Institute for Legislative Affairs to find out if that organization had a rating on Sen Toomey. The response that I received was his support for the Second Amendment was "poor". He has not responded to the NRA for their requests to find out what side of the fence he is on. While he is not up for reelection in 2014, his vote still counts (and be sure the NRA will be watching) so keep the letters coming in. The other Senator from PA, Bob Casey, is a lost cause, as he will do whatever Pres Obama wants him to do.

It seems some "conservatives" are in name only. I voted for Toomey, and supported him. I also sent him several emails and got luke warm responses from him. Very disappointing. Same with Jim Gerlach, my Rep. It seems these guys like to test the waters before committing to anything. They are certainly not there to uphold the Constitution.

The guy never impressed me. I wanted Peg Luksik on the ballot but he pretty much destroyed any chance of that happening. I voted for him as the lesser of two evils.

The tea party has been corrupted like every other movement. I was there in the start, a true grass roots movement with no leader. The point was not to have a leader, then you have different opinions that are no longer represented.

Once they saw the movement, outsiders inserted themselves into the "party". Then it changed entirely to only fiscal responsibility, no longer to focus on the social conservative issues that many were actively working on prior to the change forced by the leaders that no one wanted. :banghead:

Dear Pat Toomey,

Every law-abiding firearm owner in Pennsylvania I've talked to recently has expressed severe disappointment in your seemingly half-hearted support of the Second Amendment. I also was disappointed by the very rank-and-file response I received from you concerning recent attacks on our civil liberties.

You stated in your message that certain White House proposals could be agreed with. It is of my own and the vast majority of gun owner's opinions that none of the president's proposals can be agreed with, but we are curious as to which of his or the vice president's measures you seem to find agreeable. Before formulating a response, please bear this in mind; many attempt to illustrate the perceived need for stringent controls on our civil right to keep and bear arms and other civil rights by using the 1st Amendment comparison for not being permitted to yell "fire" in a crowded theatre. While this may be true, consider that we do not regulate the 1st Amendment by requiring individuals purchase permits to speak, much like we do here in the state of PA if one wants to protect himself discreetly or in his or her car. Nor do we limit them to certain types of speech or tools with which free speech may be disseminated, such as bans on computer keyboards, telephones, and typewriters. Nor do we require those law-abiding citizens entering the make-believe theatre to place duct-tape over their mouths in fear and anticipation that one of them may yell "fire". If a citizen yells "fire" in a crowded theatre, laws are meant to punish them after they commit the crime if panic ensues; not before. Please also realize that American citizens over the past few decades have been willing to accept certain infringements on their civil right to keep and bear arms, such as the GCA of 1968 and, here in Pennsylvania, being required to purchase and renew a license to defend ourselves with a firearm discreetly or in our cars while states like Arizona have passed Constitutional Carry laws permitting their citizens to carry a firearm for defense without any such permit. Many have acquiesced to such infringements in hopes that no further infringements would follow, but we are quickly beginning to realize this is not, nor will ever be the case.

As a Senator I would expect you to know this, but laws, particularly those concerning our God-given civil rights such as the Second Amendment, are not meant to prevent crimes from happening by harshly punishing decent, law-abiding citizens. Such laws almost always fail disastrously, if you'll remember the prohibition era or the assault weapons ban of 1993. Laws are meant to appropriately punish criminals for their deeds after they commit them, which our collective and massive failure to accomplish I personally feel is an exponentially greater contributor to the sub-culture of violence and criminal recklessness that exists in America than are responsible, law-abiding citizens such as myself who will only use any firearm we own, regardless of style or nature, as a recreational passtime, for hunting, or for defense of ourselves and other Pennsylvanians; be it against the common criminal or enemies foreign and domestic.

Please consider that I will not support you in any of your future political endeavors as I have done in the past if you do not prove a hardline stance in defending the invaluable civil liberties of Pennsylvanian citizens such as myself, liberties that countless Americans have fought, suffered and died for. I am very politically vocal in my community, and I can assure you that they also will waver in their support for you in lieu of your response should it be less than satisfactory.

The existence of the Second Amendment is vital to the continued security and survival of Pennsylvania, as well as to the entirety of the United States.

Senator Schumer has made a career of trapping hapless Republican senators into betraying their party. He is a ruthless partisan, whose siren-song for GOP sell-outs bears a substantial responsibility for the Senate still being in Democratic hands.

Senator Manchin was the "best friend of the Second Amendment" on November 5 - and its worst enemy on November 7. His capacity for stabbing his constituents in the back the moment they have elected him to a six-year term has added a new term to the lexicon: "pulling a Manchin."

If Toomey allows Schumer, Manchin, and Obama to use him to "break the back of the gun lobby," he will have snatched defeat from the jaws of victory - as we are very close to defeating ALL gun control in the Senate, if the Republicans will only stick to their guns and support the Paul-Cruz-Lee filibuster.

As you know, these three Republican Senators - Rand Paul (KY), Ted Cruz (TX) and Mike Lee (UT) - have publicly committed to filibustering gun control in the Senate.

Not only that, there are now more than a dozen Senators who have committed to filibustering any anti-Second Amendment legislation.

But Toomey’s name is not listed among them!

By filibustering gun control and keeping it from even coming to the floor, Harry Reid won’t have two weeks to score political points against Toomey by forcing him to vote on a zillion anti-gun measures - including gun bans, magazine limitations, gun owner registration and more.

But the prerequisite to this is for Toomey to join his Republican colleagues in supporting this filibuster - something he has yet to do.

And that is where you come in.

Senator Toomey needs to hear from Pennsylvanians from all over the state.

Of note here, with respect to the First Amendment and yelling "fire" in a crowded theater:

This argument, itself, is entirely invalid in the first place. The First Amendment does not provide or protect any "right" of any individual to say whatever they please in any such instances.

The right to "freedom of speech" is a restriction on the government to keep the government from censuring citizens who choose to speak out against the govenment.

Yelling "fire" in a theater, cussing out your boss at work, screaming at strippers in a night club, or any other "example" of "free speach limitations" are NOT APPLICABLE TO THE FIRST AMENDMENT.


So, the next time any "lilberal" fanatic chooses to bring up the old "yelling 'fire' in a crowded theater" limitation on the First Amendment, feel free to set them straight on that.

Forgetting all the stupid people who are unable to comprehend the complete lie about the "40%" , and assuming this idiot proposal does pass, what in the heck prevents the guy at the gun show from saying to his buyer, "Hey here is my number, call me on Monday and we can complete this as private sale."

Regarding "Internet sales" - what the heck they are trying to pass a law to address the half dozen sites like Armslist? First of all, you already have to FFL an interstate shipment. If a local guy wants to drive to meet me to buy a gun I advertise on Armslist, how is that different than placing a classified ad in the local paper?

I think they are all having Diana DeGette "mazazines are bullets and they get used up" moments. I am not for one minute suggesting that we give an inch, I just am baffled by what they think this actually accomplishes...
