The troopers office told me that it was illegal for me to purchase the firearm. Not to have it. It is LEGAL for my parents to gift the firearm to me. Its illegal for me to purchase it.

And the point isnt the one year wait. Its the fact the law says I can, and for no reason Im not being allowed to.
Cor man 257: If your parents give you a firearm, that is OK, not a problem...(other than the NYS pistol permit necessary to purchase and own said pistol) Remember, you need that pistol permit (not a permit to carry) in NY before you can even "touch" (possess) a pistol.

The problem comes when your money is used to purchase a pistol for you, by someone else. Your dad has to go to the gun store and purchase the weapon on his purchase permit, with his money...then it is truly his...THEN he can give it to you, and it can be yours (after you get the pistol permit) then you can apply for a permit to carry..

My suggestion to you, especially as you are a NG MP, get that paperwork in for a job with the NY state patrol. You will be 21 by the time you take the test and do the interviews. Takes forever, especially if you need a job. Temporarily, see if you can be assigned temporary active duty CID or MP with the guard there in NY...
 
Don't know if you can re-apply in person, but how about doing so in uniform (ASUs if you got em), perhaps with a photocopy of the regulations in question.

A friend of mine was NYNG, had some issues with a permit, was close enough to stop by in person, on his way up to his station in uniform. He said issues were resolved pretty quickly, with a smile. Course, that's upstate NY, and a few years ago...
 
Um, JAG can give you general legal advice as a courtesy mostly. The only thing they will actually represent you on is matters directly concerning your military service. They could care less if you have a civilian carry permit, not their problem.
 
hermannr: I was talking about after I have the NYS Pistol Permit. And I have been made aware of the Straw purchase concept. There are ways around it but as I have already stated I do not intend to go down that road.

That issue aside, I was trying to bring to the forground the fact that they dont even follow there own laws.

wojownik: I was never allowed to apply in the first place. And Im in upstate New York. Born and rasied on the border of Otsego and Chenango counties. Now Im going to school in Scoharie(sp?). So they are who im dealing with. Oh, and our uniforms are ACUs.

mljdeckard: Thats odd... because I know they have represented soldiers in custody battles and other nonmilitary related issues... Denial of rights is an issue. You might be correct, I dont have a hell of alot of time dealing with JAG. But my understanding was that they will represent soldiers on any issue they need representation. But you could be correct.

Im not pressing the issue. Because even if I fight and get the right to apply... the judge may deny me simply because ive made an issue.
 
I don't think a polite letter from an attorney asking for consideration of your application and reminding the court of the military veteran exemption will ruffle any feathers.
