? about Michigan CCW

I just recieved my CCW permit today and was wondering if it's necessary or the law to carry the green safety inspection card on your person while carrying that perticular gun?? Thanks! drf
 
To the best of my knowledge, it's not necessary to carry the green cards. I don't, but I do carry a 1 page photocopy of the cards for all my carry guns, not because it's required but just to have evidence of legal ownership in case of an encounter with a LEO. I'm just the boy scout type . . .

CCW & Green Card/Mich

According to the Oakland County Sheriff's Dept., you must have the registration card with you at all times with the pistol is on you.

MCRGO's website FAQ says:

Q: When I registered my pistol I was given a green card. Do I have to have that card with me whenever I have the handgun (e.g. when I go to the range)?
A: Michigan does not have a pistol registration law - it has a "safety inspection" law. Once the pistol has been presented for the inspection, you have complied with the law. The form you are given is a good record for you to keep. It shows that you have complied with the law if that is ever called into question and is a good record to have if the pistol is stolen or you want to sell it. There is no requirement that you have it on your person. Put it in your lock box, or wherever you store other important papers.

There is no legal requirement that you carry your green card with you at any time. Having said that, many cops believe it is a requirement and will hold onto your guns while they run it through LEIN to confirm ownership. If the computer is down, they will confiscate the gun until you can provide proof of ownership. It's not right, but it's what is being done.

I think carrying your green card, or a copy of it, is a good idea that may save you some hassles down the line.
 
Michigan doesn't have a CCW licence. We have C.P.L.

I did not know that the ownership of pistols could be traced through LEIN, the Michigan Law Enforcement Information Network. Thanks for the info.
 
We ALL know that. If it was a safety inspection, they wouldn't have a clerk do it, and they wouldn't keep records forever.

I recently found I had misplaced the Michigan "safety inspection" card for one of my guns during a move. When I went to the Oakland County Sheriff's Dept., they were immediately able to look up the record on their computer and issue a replacement.

Again, I was told by the Sheriff's Dept ..."you must have your 'green card' whenever the gun is in your possession". Well then, while you might win in court, it's pretty clear how the police view it.

Soooooo....if it quacks like a duck, waddles like a duck and flies like a duck, it MUST BE A.....registration?

The deputy you spoke to is misinformed. Not that is out of the ordinary. But you are not required to carry the green card. And you won't be going to court over it since you didn't violate any laws.
 
Safety Inspection Certificate

At one time, the safety inspection certificate was required to be carried. That requirement was removed with the 2001 change in the law. The LEIN system does have CCW info on it, but not pistol registration (safety inspection information). Safety inspection data is kept by the MSP forever.

There has been a movement to transfer the pistol registration info onto the LEIN system, but not for CCW purposes. Rather, police organizations want PO's to know if there are handguns present at an address when responding to a domestic run.

It appears that pistol registration information can be gathered through LEIN already. LEIN is linked to other databases.

This document in the link, above, states that LEIN "Interfaces with a multitude of other databases that have been developed over the years, as listed below, making it a prime example of integration. Through the old "LEIN line" communications structure, agencies can enter information only once and obtain information from the following:

"Pistol registrations
Carrying Concealed Weapons (CCW) permits"

Write a nice poilte letter to the Oakland County Sherrif and quote the law and that it has recently changed. Ask him for clarification as to why his department keeps giving you the advise that the card must be carried. See if you get a response. if not contact the Michigan Coalition for Responsible Gun Owners (www.MCRGO.org), join, and see what they can do about it.

Also, if you don't get a response, write your state rep and have him ask the Attourney General for an Opionon then have him send that to the Sherrif.

Remember, the Sheriff works for you.
 
JayGee, Sheriff Bouchard is a legend in his own mind! He is anti-gun and in this case doesn't have a clue. Why would one be required to carry a Safety Inspection Certificate? Possibly in case the trigger fails:D Regards, Richard:D

Only if it was initially registered in Oakland County. After I moved from Macomb County to Oakland County, the county had no access to the prior safety inspections. They suggested that I bring in the fire arms and they would give me all brand new, shiney, laminated safety inspection certs.
 
Stevie-Ray, gun registration by any other name is still gun registration. My guess is if they called it gun registration when it was started it wouldn't have flown. Regards, Richard:D
