I didn't know how to title this so I did the best I could. I was browsing the official movie site for the upcoming movie Saw II and encountered something called "Age Gate" which is used to verify age to allow you access to the more "gruesome" area of the site (although it wasn't very gruesome). I entered some bogus name, zip, and DOB like I often do for crap like this. Imagine my surprise when it rejected me because my info did not match any government ID records. So, just for grins, I put in the correct info and it let me pass. Below are screenshots of the various messages that were returned just so I can prove I am not crazy. Just exactly how can a private company justify accessing government records to confirm information like this? Shouldn't this exact type of thing be something we need to be fighting tooth and nail against? Just wait until Real ID comes to fruition. I hate to think of the abuses to the system then if we already have this sort of thing occurring.

This little blurb must allow that then???

§ 2721.
(b) Permissible Uses.
(3) For use in the normal course of business by a legitimate business or its agents, employees, or contractors, but only—
(A) to verify the accuracy of personal information submitted by the individual to the business or its agents, employees, or contractors

Good question! I’m not sure about that, however it is my understanding the law was designed to prevent this type of intrusion. It maybe covered somewhere in the CHILD ONLINE PROTECTION ACT, I’ll have to take a quick peak at it. As Pilgrim pointed out they are probably using another source for age verification.

Unrelated but interesting (18 USC Sec. 2516) CHAPTER 119 - WIRE AND ELECTRONIC COMMUNICATIONS INTERCEPTION AND INTERCEPTION OF ORAL COMMUNICATIONS http://uscode.house.gov/uscode-cgi/fastweb.exe?getdoc+uscview+t17t20+1095+0++() a

Were the zip code and birthdate that you originally entered valid ones?

Used to be you could type random digits into these and stuff like this would accept it. Nowadays, it seems they are set up to reject obvious fakes like putting down a birth year as being in 1910 or something.

For stuff like that, I just use Bug Me Not.

Yep. I used a downtown FTL zip and my DOB off by a few days and one year.

You can also pull all kinds of info from the local Tax office, Registry of Deeds and Clerk of Courts.

Ok DL information in my state is protected under Chapter 123, Section 2721 of the US Code (Driver Privacy Protection Act) and NC GS 20-43.1. See information release waiver http://www.ncdot.org/DMV/forms/driverslicense/download/dl_dppa_1.pdf
