SYNOPSIS: This bill would require each person who
possesses an automatic or semi-automatic weapon to
register the weapon with the Department of Public
Safety pursuant to procedures established by the
department. This bill would define automatic or
semi-automatic weapon. This bill would restrict the
use of the information received from the
registrants. This bill would provide for penalties.
This bill would provide for the disposition of the
fees and penalties.
Amendment 621 of the Constitution of Alabama
of 1901, now appearing as Section 111.05 of the
Official Recompilation of the Constitution of
Alabama of 1901, as amended, prohibits a general
law whose purpose or effect would be to require a
new or increased expenditure of local funds from
becoming effective with regard to a local
governmental entity without enactment by a 2/3 vote
unless: it comes within one of a number of
specified exceptions; it is approved by the
affected entity; or the Legislature appropriates
funds, or provides a local source of revenue, to
the entity for the purpose.
The purpose or effect of this bill would be
to require a new or increased expenditure of local
funds within the meaning of the amendment. However,
the bill does not require approval of a local
governmental entity or enactment by a 2/3 vote to
become effective because it comes within one of the
specified exceptions contained in the amendment.

A BILL TO BE ENTITLED AN ACT:

To require each person who possesses an automatic or
semi-automatic weapon to register the weapon with the
Department of Public Safety pursuant to procedures established
by the department; to define automatic or semi-automatic
weapon; to restrict the use of the information received from
the registrants; to provide for fees and penalties; to provide
for the disposition of the fees and penalties; and in
connection therewith would have as its purpose or effect the
requirement of a new or increased expenditure of local funds
within the meaning of Amendment 621 of the Constitution of
Alabama of 1901, now appearing as Section 111.05 of the

Official Recompilation of the Constitution of Alabama of 1901,
as amended.
BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:

Section 1. This Act shall be known and cited as the
"George Amison Jr. Act".

Section 2. (a)(1) Any person who possesses an
automatic or semi-automatic weapon shall register the weapon
with the Department of Public Safety pursuant to the
procedures established by the department. The registration
shall contain a description of the weapon that identifies it
uniquely, including all identification marks, the full name,
address, date of birth, and thumbprint of the owner, and any
other information that the department may deem appropriate.
The department may charge a fee for registration of up to
fifty dollars ($50).
(2) The department shall maintain the information
received from each registrant in an automatic or
semi-automatic weapon registry and information contained in
the registry shall be released only to law enforcement
officers.
(b)(1) Failure to register an automatic or
semi-automatic weapon is a Class A misdemeanor.
(2) Notwithstanding subdivision (1), failure to
register an automatic or semi-automatic weapon is a Class C
felony if the weapon has been used by the person in the
commission of a crime.
(c) The proceeds from the fees or fines received or
collected by the department or any court under this act, less
administration and processing costs, shall be deposited into
the Alabama Crime Victims Compensation Fund.

Section 3. For purposes of this act the term
"automatic or semi-automatic weapon" shall mean a weapon that
shoots, is designed to shoot, or can be readily restored to
shoot, a succession of bullets so long as the trigger is
depressed or until the ammunition supply is exhausted or a
weapon that fires a single bullet each time the trigger is
pulled, without the need to manually operate a bolt, lever, or
other firing or loading mechanism. The term does not include
any firearm modified to render the weapon permanently
inoperable.

Section 4. Although this bill would have as its
purpose or effect the requirement of a new or increased
expenditure of local funds, the bill is excluded from further
requirements and application under Amendment 621, now
appearing as Section 111.05 of the Official Recompilation of
the Constitution of Alabama of 1901, as amended, because the
bill defines a new crime or amends the definition of an
existing crime.

Section 5. The provisions of this act are severable.
If any part of this act is declared invalid or
unconstitutional, that declaration shall not affect the part
which remains.

Section 6. This act shall become effective on the first day of the third month following its passage and
approval by the Governor, or its otherwise becoming law.

Automatic firearms are already registered aren't they...

I swear, do politicians take some kind of short bus test, the lower the IQ the higher the pay scale :confused:
 
I can't imagine that something like this would really pass in AL. But who knows? Crazy things can happen.

This is an American adult who was elected to hold public office? Absolutely unbelieveable.
 
Should this sort of thing be enacted, one might wonder as to what happened to the common sense of the Alabama Legislature?

As a citizen of the great State of Alabama, I have been wondering this for some time.

I have touched my representatives regarding this issue. I don't think it stands a chance, but I will not risk it by staying silent.

That could get expensive in a hurry. That would be about 1/3 of what I paid for my 10/22 a few years back. What a crock. Folks down there need to take a loud stand on this in a hurry.
 
Now, it may not be very high-roadish, but why is it all of the left wing loonies that are trying to force stuff through like this are also lesbian/gay?

They're not planning to take your guns.

I know this, because law enforcement is mostly made up of regular, honest Joes, who would never encroach on your rights.

I remember reading something to that effect recently.

Probably not really relevant, though, because it related more to a new-ish technology that probably won't be abused.

Anyway, they're just trying to reduce crime. No, really.

However, reducing crime by chasing violent felons is risky stuff, so it's probably better to chase lower risk criminals.

But where are we going to get lower risk criminals, anyway?

Hey, I know, we could enact a law that would, just by its very existence, tend to encourage non-compliance by otherwise law-abiding folks. And that would give use a fresh supply of "criminals" to chase who'd probably not shoot back.

In the rural community where I used to live, every household that I was aware of had a .semi-auto 22rf, and some type of semi-auto smoothbore, usually a Rem Mdl 11 or an Auto 5.

I doubt if some of those 22s were worth 50.00 retail.

Alabama? I would expect that this isn't going anywhere, but you never know so now is the time for action. How can those of us who are not Alabamians help?

Who is the George Amison for whom this screed is named? He must be a piece of work.
 
UDATE! Email from bill's Author!!

I emailed Patricia Todd thru her website yesterday and got the following response back today.

"I am not pushing passage of this bill and it will die in the committee."

I guess she had a change of heart!!
 
HOW exactly would that prevent a crime such as what happened?! Or any gun crime at that? I will never understand what these politicians are thinking! I'm getting so tired of these "feel good" political moves that ONLY affect LAW ABIDING gun owners. What is it going to take for them to get it? We need criminal control. How come everytime something happens like this, I hear all this legislation restricting access to gun but NOTHING about punishing the people who rob, steal, rape, and murder? I say if you commit a violent crime and hurt somebody or a crime with a gun, lock em up and throw away the key! Sorry about the rant, i'm just wearing thin with these ignorant politicians. Justin

In my mind, the fact that she's not pushing passage anymore means exactly jack squat. She was an original sponsor of the bill!
