Alabama rest areas do not fall under the "prohibited places" as outlined by 13A-11-61.2.

I covered that. I didn't mean to imply Handgunlaw was saying rest areas were a prohibited zone. I do not consider them a good legal resource for gun laws. As of yesterday it is a moot point since the signs are now down.

Signs on business and private property do not carry the rule of law according to 13A-11-52. Refusal to leave results in trespassing but not a firearm related felony. 13A-11-52 covers every place that is not covered by 13A-11-61.2

Alabama DOT To Ban All Guns At Rest Stops; Citing Possible “Threats” Of Gunowners


In a surprising move from a rather conservative progun state, Alabama Department Of Transportation has just made it into law that firearms are strictly prohibited at all ALDOT rest stops. This grave error poses great risks to travelers as they will be subjected to fines, arrests, and now possible targets in yet another gun free zone.

This move by ALDOT completely ignores the concealed and open carry laws of the state. Signs will be posted soon that have the words “no weapons beyond this point”.

I haven't heard anything about it and I seriously doubt it. Yellowhammer.com, Alabama's source for news was all over the controversy and it's ultimate end (the governor ordering the signs removed) and yet there is absolutely nothing reported on their site about a reversal. A reversal would be BIG local news yet there is nothing anywhere about it so.....
 
After 45 years of driving in Alabama and going in a million rest areas with a gun on my person I am still wondering what good the law ever did.

It is/was an interesting grey area. As the signs were only posted on the buildings and not in the parking or walking areas.

As far as the reversal, I have no idea. I usually visit the website al.com for Alabama state news as I don't have cable TV and only get the local county newspaper. The last story al.com has is about the signs being taken down on the 24th.

I guess I'm way behind, I hadn't heard a thing about this locally. This thread is the first I've heard of it and thanks to the OP for bringing it up.

But firstly, I didn't know that it is/was illegal to carry on the premisses. Second, is it now legal to carry at rest stops? Can anyone link a current article? I really don't like rest areas, well my dad was a long haul driver and he told us too many horror stories. However, I would like to know for sure.

herrwalter, I suggest dropping al.com as it has very liberal leanings. I recommend yellowhammer.com for Alabama in state news. Compare the two and I'm sure you will agree.
 
Stopped at two AL rest areas today before I noticed this thread. I59 and I65.
There was an attendant in the I59 rest area, I doubt he was armed, he was reading a newspaper.

I did not notice any handgun signs. I did notice no pets allowed in building signs.

I am rather liberal on most social issues. Although firearms is not one of them. So I don't mind reading liberal or left leaning news sources. And yellowhammer doesn't show up anything AL news related.

I think we just had some confusion. yellowhammer.com looks like an ISP sign up. yellowhammernews.com is the news site. I will take a look at it.

I feel the same way. Always chalked it up to being a transplant yankee. When I first moved here the DMV asked if I wanted an Auburn or UAB plate. I couldn't understand what she meant.

But anyway back on topic, haven't seen any new updates. Other than the Guns N Freedom blog, haven't seen anything about a reversal.
 
I am headed south this weekend and will stop in the Rest Area south of Eufaula. I imagine I have been there a million times in my life and have never noticed a sign but that doesn't mean it's not there.

Alabama Attorney General Luther Strange.

On July 29, Strange released public statements about complaints he had received concerning unlawful prohibitions of firearms.

Strange said complaints he received and a subsequent inquiry from his office prompted the Department of Transportation to announce last week the reversal of its prohibition of firearms at public highway rest areas in violation of state law. In addition, the city of Moulton removed signs prohibiting firearms at Moulton Recreation Center and at H.A. Alexander Park after being advised by the attorney general that the prohibition violated state law.
 
I stopped at the rest area just south of Cullman on 65 today just to see and the signs are gone.
 
Why?
I don't, and don't plan to. My FL cwp is honored, I don't drive at 100 in a 20 school zone or ask the cop to hold my beer when stopped ( remember Jeff Foxworthy?)

Obey the law, yes.....but stop being paranoid if you are a normal law-abiding citizen
