In a post about an email response regarding the Vitter Amendment to HR 980, THR member TwitchALot posted a speech by Senator Tom McClintock dated June 9, 2001.

In this speech, Senator McClintock described senator Sheila Kuehl as STATING 'The only constitutional right which is absolute is your right to believe anything you want.'

Well, all senators must swear an oath.

'I do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter: So help me God.'

Although I would very much like to consider the statement that Senator Kuehl made to be criminal, that is very unlikely, as it can certainly fall under free speech.

BUT, considering the oath that is sworn, I believe that such a statement regarding the constitution can be considered a violation of TERMS OF EMPLOYMENT. A senator is employed by the people, and the terms of this employment are that the Senator must perform in a manner that they have sworn to do so.

I'm thinking this could be a basis for some kind of grass roots activity to single out and expose senators that hold no regard for the Constitution that they have sworn to defend.

I actually think this movement would appeal to all political parties, as the more I talk to people, the more the main issue seems to be disagreement on which party tramples on the Constitution MORE, rather than any disagreement on the Constitution itself.
