I know Sam1911 is going to love this thread. It has been said numerous times on here that Obama cannot use EO to ban assault weapons. The issue keeps being brought up in news articles though.

This is the most recent one that I have seen. It says that while Obama may fight an uphill legal battle if he were to issue and EO banning "assault weapons," he may still try and do it. My question is, say he issues and EO banning "assault weapons," knowing that it will create a legal battle that takes years to work its way through the courts, but will most likely be overruled by the Supreme Court. What happens to all our current guns during the process.

I believe that if he were to try something like this, he would include "possession" of these guns to be illegal.

We talked about the legal issues associated with executive orders in this thread, this thread, this thread, and this thread.

If Obama does try to exceed his authority through the issuance of inappropriate executive orders, what will happen and how things play out will depend on exactly what he does and how he does it. Until he actually does something, all that is pretty meaningless speculation.
