yes - IF the buyer has a Green Card (permanent resident) and therefore is NOT in a non-immigrant visa status (for e.g. H1B, F1) ... he / she can buy a firearm if they are residing in the state of the transaction and have both a state DL and their Green Card.
Non-immigrant status aliens can still buy guns if they fall into the exception categories. The "easiest" one is the with "holding a valid hunting license". So they basically need to fill out the form correctly, show their passport + State DL + hunting license.... it's a bit of a pain and many store don't know about that exception rule... but perfectly legal.
How do I know? Well... I came to this country back in 2006 and have been on various visas until I got my Green Card. Citizenship is next in 2 yrs
