(CNSNews.com) - The federal government confirms it is investigating New York Mayor Michael Bloomberg's sting operation against gun dealers in five states.

Five months ago, The Second Amendment Foundation called on U.S. Attorney General Alberto Gonzales to investigate Bloomberg for obstruction of justice relating to Bloomberg's "rogue" operation.

SAF founder Alan Gottlieb said he has just received a letter from W. Larry Ford of the Bureau of Alcohol, Tobacco, Firearms and Explosives, confirming that the agency "is investigating the matter in order to determine if violations of federal firearms laws occurred."

Ford, the director of ATF's public and governmental affairs, did not offer details on what he called "an open investigation."

"We're delighted that ATF is taking this matter seriously," Gottlieb said.

"Mayor Bloomberg dispatched private investigators to several states, where they apparently made straw gun purchases in an effort to file civil lawsuits against gun dealers. The mayor refused to turn over alleged evidence obtained during this vigilante operation to ATF or other proper authorities, and instead exploited the affair to advance his own political agenda."

The Second Amendment Foundation says neither state nor federal statutes give the mayor of New York -- or any other city -- the authority to launch such a "rogue investigation," especially one that extends beyond his jurisdiction.

"Our letter to Attorney General Gonzales raised serious questions, and I am now assured that the ATF is looking for some serious answers. Mayor Bloomberg should step forward and provide those answers without delay, Gottlieb said.

"In the end, we understand that a final decision whether to prosecute Bloomberg and others involved in last year's illicit sting is up to the Justice Department," Gottlieb added.

"But right now, it appears that ATF is doing its job in a slow, deliberate and painstaking manner."

Last year, Bloomberg's office hired private investigators who wore hidden cameras while trying to make "straw purchases" from federally licensed gun dealers in Georgia, Ohio, Pennsylvania, South Carolina and Virginia. The goal was to prove that out-of-state stores contribute to crime in New York City.

In May 2006, Bloomberg announced that the city was filing a civil lawsuit in federal court against 15 gun dealers who allegedly allowed such purchases to take place.

Around the same time, Mayor Bloomberg and Boston Mayor Thomas Menino formed a "Mayors Against Illegal Guns Coalition," a bipartisan group of mayors who are trying to get illegal guns off the streets.
 
(Keeping fingers crossed) If he is in fact guilty, and by his own admission, he is the coordinator of this so-called sting, then let him be subject of the same law of the land we all are subject to. Correct me if I am wrong, but I believe 10 yrs in jail and heavy fines?
 
This is great news.

His 'sting' needed to be investigated.

Has anyone looked into the possibility of a large order for WHITEWASH, having been placed by the stalwarts down there at BATFE?

WHITEWASH, has, in the past, come in handy respecting other "investigations", as such things are carried out by government agencies.
 
how do the dealers know what the person they are selling the gun is going to do with it? i could go to georgia buy a gun and sell it to someone face to face if i wanted. i mean there is no check behind this is there? if there is not this guy should get a sentence for every state he did this in because infact he was basically the one the straw purchase was for.. 15x10yrs=150 years :D Hope you like bubba Mr. Bloomberg
 
The groups demanding the investigation brought up some good points, and the BATFE pretty much had to "investigate." However, NOTHING will come of it. The only serious effort by the BATFE will be in figuring out how to let him off.

you never know... Blomberg is not exempt from federal charges. He clearly stepped on their toes in fact. More than 1 Mayor of a major city has or is serving time for other crimes commited...
 
Charges could very well come from it, maybe not at Bloomberg but at other folks involved.

If Federal gun laws were broken, someone will pay.

It's whether Bloomberg did anything wrong.
 
Bloomberg is one of the "elite". They don't hang each other out to dry. He'll get a slap on the wrist at most. Remember the Clinton cabinet member who got caught stealing and destroying national documents. What did he get? Nothing. Same thing will happen to Bloomberg.
The ones doing the straw purchasing could get in trouble also. Those are who we should go after. They are to low on the food chain for people like Bloomberg to care about. Hit them hard enough and no one else (of the little guys) will go along with Bloomberg's plans.

It is furiously to hope...seeing as how he's trying to use his little entrapment scheme to put other, hardworking people there...but I wouldn't hold my breath. With the outraged cry coming from his cronies and others of like mind, the case won't likely make it to the federal court docket.

"The actions of the BATFE in charging Mayor Bloomberg after his heroic attempts to do something about gun violence is incomprehensible, and we won't stand for it! We'll petition the US Supreme Court if we have to in order to see this great humanitarian cleared of any and all charges...and we WILL demand an apology from the Bureau of Alcohol, Tobacco, and Firearms!

Complete with all anguished expressions and, of course...a diatribe from the Hollywood set. Yeah...This has the makings of a real circus.
 
Meet the new Boss...

Blomberg pretends to respect the Second Amendment but works to prohibit all personal ownership of firearms. The BATFE pretends to respect the Second Amendment but works to prohibit all personal ownership of firearms. I think they just got enough heat that they just have to go through the motions. Both Blomberg and the BATFE have the same goal and both are above the law.

I'm not expecting anything but whitewash.

Unfortunately, people like bloomberg, hillary, kennedy(aka the hero of chappaquidick), m. moore, etc etc don't live under these rules,:cuss:and are above the laws that regulate/suffocate the rest of us?:banghead:

Since his investigators committed a FELONY, by lying on the form 4473, throw Bloomberg and his cronies in jail! I believe the penalty is 50K in fines and 5 years in prison, I hope you enjoy bubba Bloomberg.:D THROW HIS ASS IN JAIL! Elitist tryant SOB! Not to mention his little stunt jeapordizes 18 active ATF investigations, I would think that they are a little pissed at him as well.

I don't know why the SC State Law Enforcement Division doesn't bring stste charges against his minions; that could lead to their turning on Bloomberg, with a conspiracy charge in SC state court.

Feds shoot down Mike's gun suit

The federal government will not file criminal charges against any of the 15 out-of-state gun dealers accused by Mayor Bloomberg in a federal lawsuit of selling guns illegally, the Daily News has learned.

In a stern rebuke to the city's high-profile crusade against illegal guns, the feds warned the Bloomberg administration that it could face "potential legal liabilities" if it continues to conduct sting operations that fall within the jurisdiction of federal agents.

Bloomberg announced the filing of a federal lawsuit last May against 15 gun dealers, who he lambasted as the "worst of the worst." The city later filed a similar lawsuit against another 12 dealers.

In both cases, the city sent private investigators to gun dealers and secretly videotaped them making what Bloomberg called illegal "straw purchases."

A "straw purchase" refers to when an individual talks with a store clerk about purchasing a gun, but then gets another person to fill out the required federal forms and undergo the mandatory background check.

According to a letter sent to City Hall, the Bureau of Alcohol, Tobacco, Firearms and Explosives and various U.S. attorneys' offices have determined the city's findings against the 15 dealers "do not rise to a level that would support a criminal prosecution."

The letter - sent Tuesday by Michael Battle, director of the executive office for United States Attorneys at the Department of Justice - also scolded City Hall for engaging in sting operations involving persons "without proper law enforcement authority," saying that could put the city in legal jeopardy. Battle added that City Hall could "unintentionally interrupt or jeopardize" criminal probes.

Asked if the Bloomberg administration plans to stop conducting the sting operations, Deputy Mayor Ed Skyler said, "Not necessarily."

"The city hasn't violated any laws," Skyler said defiantly, adding that the city will continue to pursue its civil lawsuits against the gun dealers.

Not only are officials immune from the laws, they are so confident as to publicly flaunt warnings. Remember this article, when our resident apologists parrot the laughable claim: "officials must obey the same laws as common citizens; the rule of law must be upheld! (clicks heels) :barf:
