ATF Proposed New Rules for NFA Trusts

Co-worker sent in a trust, was returned saying all trustees need prints and CLEO signoff.

I think there is some sort of misunderstanding about the letter or that some details are wrong. Title 26 Chapter 53 paragraph 5812 says;

(a) Application. A firearm shall not be transferred unless ....(3) the transferee is identified in the application form in such manner as the Secretary may by regulations prescribe, except that, if such person is an individual, the identification must include his fingerprints and his photograph;
So a natural person must use photos and fingerprints while trusts use whatever the Attorney General wants, including photos and fingerprints.

Title 27 CFR Chapter II only requires that a natural person who is not an FFL obtain the CLEO signature. I don't think any executive order or whim of the AG is going to require a trustee to obtain a CLEO signature.

I've got a 4 pending on a RLT that I thought might get sprung just before Christmas. The shutdown will likely push that past New Year's, but if I get any type of similar request for the bureau, I'll post it.

Does the Government need to be open for business during the 90 day comment period, IE: "If we all write, but nobody is there to read the comments, has the comment period been offered"?

I suspect that in the interest of public safety :barf: the ATF made their decision months ago. Regardless, I provided my comments and demanded to see the study of how many convicted felons (already precluded from possessing a firearm), were spending the money to form a Trust or Corporation, sending the ATF $200 and waiting 6-7 months for their NFA stamp. I just can't imagine this happening. A felon concerned about violating the NFA but doesn't care about getting caught possessing a firearm? I suspect that one day all semi-autos will fall under the purview of the NFA via "rule changes" then the books will be closed like they were with machineguns in 1986. Whatever! :mad:
