New Orleans Voters Go To Court Over Elections Delay, GOP Chair Threatens Recall

December 13, 2005 XXXX 1:00 PM CT

(NEW ORLEANS)- Today, Judge William A. Morvant, 19th Judicial District Court, set a hearing date of December 23 regarding the delay of the February 4th New Orleans municipal elections. Rob Couhig, attorney representing the petitioning voters, argued that Governor Blanco stepped beyond the limit of Louisiana law when she signed an executive order indefinitely delaying the elections.

Today Couhig also announced that 60 more voters have joined the legal battle to stop the delay of the municipal elections. The amended petition including the names of additional voters was filed today.

The amended petition states: “The voter group is comprised of individuals of diverse races, political philosophies, and backgrounds including musicians, veterans, students, business persons, homemakers, physicians and others both currently residing in New Orleans and displaced to other locations. All are linked by the common thread of wishing to exercise their constitutional right to vote in the February 4, 2006 municipal elections.”

The petition filed by the voters continues: “Elections are a keystone of democracy. They allow for a healthy debate and resolution on the philosophy and leadership that the majority of the voting public wishes to pursue. The people of the City of New Orleans need to be able to elect their leaders on a timely basis.”

Couhig is a New Orleans attorney has argued in dozens of states and the US Supreme Court. He is also known as an innovative entrepreneur and the former owner and founder of the New Orleans Zephyrs.

GOP CHAIRMAN SAYS BLANCO SHOULD STEP ASIDE AS GOVERNOR, THREATENS RECALL

Roger F. Villere, Jr., Chairman of the Republican Party of Louisiana, today called on Governor Kathleen Blanco to hold elections in Orleans Parish during the next few months or to step aside as Governor and allow someone else to lead Louisiana.

“Governor Blanco’s order to indefinitely suspend elections in Orleans Parish appears to be an abuse of power that makes her unfit to continue to serve as Governor of Louisiana,” Villere said. “The anger in this state is at a boiling point. If the Governor wants to avoid impeachment or recall, she must immediately change her ways and begin performing the most basic functions for which she was elected,” he said.

“Because of the tragedy of Katrina and my hesitancy to distract Governor Blanco from her duties, I was silent for a long time after the hurricane hit the state. But I am putting the Governor on notice that she has now crossed the line. We have tolerated her gross malfeasance in office, but her Executive Order to take away the right to vote from American citizens is another whole matter. On behalf of the citizens whose rights are being violated, I demand that the Governor hold these elections in a timely manner or face the most severe political consequences from the voters of this state and their elected representatives,” Villere said.

“Governor Blanco has been forewarned of the political consequences if she does not change course. I urge her to reconsider her plan to commit what amounts to legalized voter fraud in Orleans Parish. There are some principles that transcend partisan politics. The right to hold free and fair elections is one of them. If we can conduct elections in Afghanistan, Iraq and St. Bernard Parish, surely we can hold elections in Orleans Parish. If Governor Blanco will not allow an election, then she must forfeit her own,” Villere said.

Actually, considering the recently increased number of dead, one wonders why the representatives of the Democratic (sic) party don't embrace the election with open arms.

I assume 2 things:

1) No authority to indefinately suspend elections exists.
2) And if it does, any foundation of governance that includes the executive power to indefinately suspend elections is fatally flawed and DOA.

Therefore:

Battle of Athens is right.

This is third world banana republic BS.

The voters should hold elections ON THEIR OWN AUTHORITY, using whatever force is necessary to do so.
 
New Orleans is already organizing next year's Mardi Gras, but they can't organize an election. Yeah, right... :rolleyes:

As almost everyone with a brain in Louisiana knows, the real reason for the indefinite postponement is that the Democratic party majority in the LA House and Senate is utterly dependent upon their party machine in New Orleans. Without that, and without those votes, they'll lose the state to the Republicans in a heartbeat. Since the voters are now scattered all across the country, the Democrats are desperately trying to:

1. Persuade them to come back;

2. Persuade them to vote by postal ballot if they're not coming back.

The fact that (2) is illegal if they've become residents of another state (as evidenced by a drivers license or other identity documentation from that state, a residential address there, school enrolment of their kids, etc.) is being completely ignored by Democrat legislators here. I predict that there will be all sorts of lawsuits to derail their electoral boondoggle, and a great deal of dirty fighting ahead.

Hmmm . . . I remember reading that Mayor Nagin actually bought a home up around Dallas and put his kids in school there.

Anyway, suspending elections "indefinitely" is what you expect in some turd world banana republic, not the USA. Ms. Blanco ought to spend some time in the Fed's Graybar Motel for pulling this kind of <scatological expletive>

If I remember, it was General Tommy Franks talking about a large scale terrorist attack taking out major portions of the country. This would lead to martial law for a time (which I'd expect) and would impact elections.

Could have that wrong, but I don't remember any high placed sources of a civilian nature indicating suspension of elections.

Of course I could be under read.

Unfair!!

It is a grossly unfair thought to have a vote that will likely remove the incompetent NO mayor, just when the truckloads of government money start to flow in. He should be given a shot at his fair share even if it does mean that a "small" abuse of power has to be exercised. It must be noted that the small time corruption prevalent in NO previously, was not sufficient to allow him to gather as much wealth as some other folks in Baghdad for instance, or Africa, or other places where US taxpayer's money disappears into the pockets of the govt. officials in charge. Be fair people.

Seems to me you got it right. It wasn't anything that was going to happen. It was in case of a terrorist act or something. The leftys at the DU were calling for civil war. I had to laugh.........
